KERAJAAN PERLU MENJELASKAN TUDUHAN-TUDUHAN RASUAH YANG DIKENAKAN TERHADAP AUGUSTUS RALPH MARSHALL

1. Pada 1 Mac 2020, Kementerian Kewangan telah mengumumkan pelantikan Ahli Lembaga Pengarah dan Ketua Pegawai Eksekutif yang akan menerajui syarikat tujuan khas, Digital National Berhad (DNB) bagi melaksanakan infrastruktur dan jaringan teknologi 5G di seluruh negara.

2. Di dalam pengumuman tersebut, Kementerian Kewangan telah melantik Augustus Ralph Marshall sebagai Ketua Pegawai Eksekutif DNB yang akan menerima peruntukkan sebanyak RM15 bilion daripada kerajaan.

3. Pada 29 Mac 2012, Jakarta Post memaparkan permintaan dari Kepolisian Negara Repulik Indonesia untuk Interpol mengeluarkan notis merah penangkapan Augustus Ralph Marshall di atas penggunaan dana secara haram membabitkan sebuah syarikat di Indonesia. Meskipun kes tersebut telah diselesaikan, namun butir-butir samada kes ini telah diselesaikan melalui keputusan mahkamah atau luar mahkamah masih tidak diketahui.

4. Pada 24 September 2016, Bloomberg juga menerbitkan berita bahawa Mahkamah India telah mengeluarkan waran tangkap untuk Augustus Ralph Marshall berhubung kes rasuah membabitkan lesen telefon.

5. Sebagai Ketua Pegawai Eksekutif DNB, Augustus Ralph Marshall memegang tanggungjawab besar dalam menerajui pelaksanaan infrastruktur 5G di seluruh negara dan memastikan vendor-vendor dipilih secara telus dan profesional, dana yang diperuntukkan dibelanjakan dengan baik, dan pembangunan infrastruktur dapat dicapai berdasarkan tempoh waktu yang ditetapkan.

6. Oleh itu, PEJUANG mendesak kerajaan untuk mengesahkan dengan segera status tuduhan-tuduhan terhadap Augustus Ralph Marshall di India “Central Bureau of Investigation (CBI)”, Indonesia dan di negara-negara lain.

7. Pengesahan ini perlu dibuat sejajar dengan kenyataan rasmi Kementerian Kewangan yang menyatakan bahawa DNB akan dikendalikan berdasarkan "kerangka governans yang sesuai dan amalan terbaik global". Kementerian Kewangan harus mengotakan komitmen ini dengan mengesahkan kredibiliti pelantikan Augustus Ralph Marshall.

8. Cadangan penubuhkan syarikat infrastruktur telekomunikasi milik kerajaan bukanlah suatu perkara baru. Ianya pertama kali dicadangkan pada tahun 2017 dibawah kerajaan Barisan nasional dengan Augustus Ralph Marshall telah pun dilantik sebagai salah seorang Ahli Lembaga Pengarah Broadnet Sdn. Bhd., iaitu sebuah syarikat yang diamanahkan untuk membina infrastruktur rangkaian jalur lebar berkelajuan tinggi. Cadangan ini telah dibatalkan oleh Kerajaan Pakatan Harapan yang memihak kepada proses tender oleh syarikat swasta. Pada tahun 2018, syarikat tersebut telah menyerahkan lesen operasi mereka kepada Suruhanjaya Komunikasi dan Multimedia Malaysia (SKMM).

THE GOVERNMENT MUST EXPLAIN AUGUSTUS RALPH MARSHALL’S PAST ALLEGATION OF MISCONDUCT AND CORRUPTION

1. On 1 March 2020, the government through the Ministry of Finance announced the appointment of board members and Chief Executive Officer who will lead and drive the Digital National Berhad (DNB) - government of Malaysia Special Purpose Vehicle (SPV) that will oversee the rollout of the 5G network in the country.

2. The Ministry of Finance appointed Augustus Ralph Marshall as the Chief Executive Officer of DNB that will be allocated with RM15 billion from the government.

3. On 29 March 2012, the Jakarta Post published a request by the National Police for Interpol to issue a red alert for the arrest of Augustus Ralph Marshall for the illegal use of operational funds at a company in Indonesia. Although it is resolved; it is unknown if it was resolved in an out of court settlement or if it was a court judgment.

4. On 24 September 2016, Bloomberg published news that India Court issued a warrant of arrest for Augustus Ralph Marshall in connection with an investigation into alleged phone-license corruption.

5. The Chief Executive Officer of DNB holds great responsibility as he will be overseeing the deployment of 5G infrastructure nationwide and to ensure that vendors are fairly and professionally selected, funds are effectively utilized within the budget and deliverables completed on time.

6. Thus, PEJUANG urges the government to urgently clarify on Augustus Ralph Marshall charges or pending court cases (if any) that have been alleged against him in India by the Central Bureau of Investigation (CBI), Indonesia and in any other countries.

7. This is in tandem with the Ministry of Finance official statement on 1 March 2021 stating DNB will be managed based on “appropriate governance framework and global best practices” among others. We urge the Ministry to start upholding transparency by showcasing the credibility and integrity of the appointee in question.

8. The idea of a government-owned telecommunications infrastructure company was first mooted in 2017 by Barisan Nasional government with Augustus Ralph Marshall already appointed as a board member of Broadnet Sdn. Bhd. – a company that was tasked with building the country's high-speed broadband network infrastructure. The project was scrapped by Pakatan Harapan in favour of a tender process by private operators and Broadnet Sdn Bhd had relinquished its licenses to the Malaysian Communications and Multimedia Commission (MCMC) in 2018.
