MAXIS-BERRY IS EXASPERATING

WHEN INFIDEL IS A MUST WITH MAXIS-BERRY!!

I have been a loyal maxis customer for 14 years since 1995 although I cheated on MAXIS along the way when I also register for DIGI and Celcom but never did I ever abandoned MAXIS. I was introduced to MAXIS by a high school friend Syamreen Shafei whom first bought and registered my first handphone as a graduation gift. So fortunate was I to have such a friend. I grew old until today with MAXIS.

Similar unfounded loyalty I have for NOKIA and never would I thought of betraying NOKIA especially after a short fling with BlackBerry 8707G turned sour and gave me endless nightmare but being the bastard a man is, last year, I cheated again on NOKIA. I booked and bought from MAXIS the latest BLACKBERRY BOLD 9000 (BB) thinking I could be satisfied and fulfilled with a much younger, sexier and latest technology of the BOLD 9000. I needed the extra service that NOKIA could not give but similarly, I never abandoned Nokia but kept Nokia as the second whilst the BOLD became my primary. I needed the PUSH email and various online chat functions Google, Msn, Yahoo that BB possessed.

I flirted and picked up BB from MAXIS Taman Tun Dr Ismail branch the moment she came. She was not easy. I had to booked her online prior to her arrival. I have read all about her on the internet. She was prominent, famous and the most hip in America and Europe. The moment I set my eye on her, I knew I had to have her! She was sexier than Nokia.

She was mine for only RM1,800, a price I reckon, was worth paying since she will be MINE contractually for 2 years. It was a prenuptial agreement. Even after 14 years, MAXIS distrust my loyalty and think I will cheat and abandon her. So insecure was MAXIS.

I didn’t sleep the whole night when I first brought BB back home. I explored to know her in every detail inside and out. BB was slow but steady. She took almost 10 minutes to wake up every time she slept but when she was awake, she was wild and fast. Browsing the net was simple and easy. BB was easily controlled by the touch of her tit.

It wasn’t long before BB showed me her true colours. Her tantrum was getting worse. She fell asleep almost every time I needed her. I had to bring her to the MAXIS centre @ TTDI all the time and the visit became more frequent, again and again when her tantrums worsen. I am so familiar with MAXIS. Every visit is the same. I will take a number and wait akin of a government hospital to see the counsellor at maxis. Every time I met the counsellor, her software was upgraded but her spirit came crashing down in barely less than a month and there I go again, endless visit to MAXIS TTDI.

My BB was diagnosed with an irrevocable condition. She needed a TIT transplant! Her tit just dropped dead and MAXIS said the transplant can ONLY be done in Canada! I had no sympathy and was furious. I did not sign up for this. She left me even before her contract expired. However, Maxis TTDI was quite professional and understood my needs. Maxis said, they will replace and give me a new BB. “I cannot live without my BB! How long will it take to get a new BB” I asked in desperation. MAXIS said it usually take up to 2 weeks. Short of screaming and breaking the counter, I said, “Unacceptable!! I cannot wait that long! I need my BB NOW!” The Professional consultant at MAXIS TTDI was taken aback in silent. “Give me 3 days”, said the consultant. “I know 3 days is also a long time but I will try my best to get you a new BB in 3 days”, added the consultant professionally. I was not happy but I agree and the consultant delivered to me a new BB, 3 days later.

Maybe this was God’s punishment to me for betraying Nokia I thought to myself but was happy with my second BB. She was less in tantrum. We communicate well and our chemistry was good. I used her day and night endlessly. She seldom fell asleep and seldom left me hanging. I was fulfilled for barely 2 months when on 30 April 2009, she went blind!!! ….again drop dead on me! In barely 2 months, I became so dependant on her. She knew my every schedule, details and contacts that I cannot go on a day without her. I needed her all the time and she had became my personal assistant and secretary. Now she went blind. I cannot see her. Her face is no longer pretty with colour or sleek features but her face is just black! She can still speak and listen but I cannot see anything except for a BLACK screen.

I immediately call 123 MAXIS centre for help and seek advice at 7am on Labour Day, 1 May 2009. I was told that my regular maxis centre at TTDI is closed but the next nearest maxis centre that was open is at the KLCC and the Garden Mall. I was delighted as I could not bear to see my sick BB. I further inquired which of the two, is the best centre for me to bring my BB for a warranty claim. I was advice to go to the biggest maxis centre at KLCC which is open daily from 8:30am.

Immediately, I rushed and brought my ailing BB to maxis centre @ KLCC and arrived before 930am. I took a Q number, waited for 5 minutes and was attended to at counter 5 by a lady, her name was Ms Tang Li Yien.

I explained my BB predicament to Ms Tang. I explained in detail that I had major endless problem with my first BB and was given this second set BB as a replacement and now this BB too drop dead. I was frustrated and disappointed beyond word. All these problems are a major distress and I can’t forever be burdened with this inconvenient. The BB had tested my limits and I cannot take it anymore, I sat and look at Ms Tang impatiently waiting for answer. Ms Tang did not even look at me but fiddles with my BB. She took my BB, stripped her of the back cover and battery, and said this is a common problem and explained to me, MAXIS company policy. She reiterated the policy and this is what MUST be followed.

Now I understand. It was not the insecurity that MAXIS wanted me to sign the prenuptial agreement especially when I have been loyal for the past 14 years. It was MAXIS parentage distrust in the children they adopted. There is no recourse now for I am stuck with a dead BB.

Ms Tang, unlike those consultants @ maxis TTDI, was lousy and less attentive. All that she preaches was MAXIS company policy. I don’t give two hoots for the company policy. I am in distress. My BB is ailing and short of being dead and all that she preaches was MAXIS policy! Ms Tang said she cannot give a replacement set until she speak to the vendor and she can only do so on Monday and only on Monday will she be able to advice the status of the replacement set and if she can lend a temporary set while waiting for the availability of the new replacement.

MAXIS KLCC is maxis biggest branch and BLACKBERRY PROBLEM is (quoting Ms Tang) a common problem. How poor a service can maxis provide, having known of BLACKBERRY’s common problem and did not kept any standby set for the convenient of the customer. Ms Tang even explain, there are customers whom waited for their replacement set for already many weeks and I have to be in the same queue. Ms Tang said, there is no guarantee she can source for a temporary set for me to use but even if there is, it will be of an older version but even then, she can only check its availability next week and until then, I have to be without any handphone. Its company policy, she repeated again! I don’t want an old, less functional and underperformed BB, I want at least the same type as mine! She repeated again the stupid company policy and there is nothing that she can do!

In frustration, I took back my BB and kept her safely with me. I asked Ms Tang to initiate a report for a replacement and practically begged her to prioritise the replacement. She said she will do her best. She printed MAXIS job sheet bearing no 1865 (dated: 1 may 2009; time: 09:42).

This morning, 2 May 2009, at 9:45am, I called MAXIS call centre and spoke to a pleasant customer service officer, Ms PRIA, to check if there was any notification initiated for the replacement of my BB. After a moment of silent, Ms Pria informed me that there was no record and note of my replacement in MAXIS SYSTEM! I was flabbergasted... so much for the 'will do the best to prioritise'.. Customer service.. Urgency.. Priority.. is probably never heard of at MAXIS KLCC.

Ms Pria, sort of surprised too, having told of my conversation with Ms Tang and and the absent of any record of my request in MAXIS system. She promised she will be in touched with Maxis KLCC and asked her to call me on an urgent basis but then, urgency had never existed in MAXIS KLCC, so I wondered when when will KLCC returned my call… or will Ms tang ever returned my call? Its almost the end of the day without any call from maxis KLCC.

My sick BB is lying uselessly at home and I am hopelessly counting down the day for the replacement. A phone is a necessity. In this dire desperation, I will support polygamy of any kind and probably launched an anti-MAXIS movement! MAXIS being a reputable company should provide a serive at par if not better than that of VODAFONE or network providers in Europe. MAXIS being a network provide should adopted VODAFONE three basic principles, if they want to diverse their product range from just a network provider to selling mobile phones. If the mobile phone is still under warranty and is spoiled or damaged, MAXIS should:

No 1. Have a good after-sales-service!!! The phone under warranty should be repair on the spot at any MAXIS centres.

No 2. If the phone cannot be repaired, it should be replaced immediately.

No.3. If the phone cannot be repaired or replaced immediately at the Maxis centre, the customer should be given an OPTION to either wait for the replacement set or given a full refund and the contract should be nullified and void! Customers on contract should not be burden with poor service, bad products and ‘one-sided-against-customer-convenient-policy’.

My three experiences with Blackberry thus far, the 8707G, a brand new BB BOLD and the 1st BOLD replacement set, were all terminal and drop uselessly dead in barely less than 3 months (contract was for 2 years!). Now awaiting for the 2nd replacement set, which I doubt will be any better than the other 3 Blackberry. The least that MAXIS can do is to EXPEDITE the replacement set thus minimising further inconveniences and burden.

Helplessly, in lost and feeling empty, i can only wait for MAXIS to call.......

Peraturan 1 NAMA DAN TEMPAT URUSAN

1.1 Pertubuhan ini dikenali dengan nama Persatuan Pengedar Proton Edar Malaysia (Proton Edar Dealers’ Association of Malaysia) (PEDA) selepas ini disebut ‘Persatuan’.

1.2 Alamat berdaftar dan tempat urusan Persatuan ialah 15 & 17, Jalan Petaling Utama 11, Taman Petaling Utama, Batu 7, Jalan Kelang Lama, 46000 Petaling Jaya, Selangor D.E. atau di tempat lain atau tempat-tempat lain di dalam Semenanjung Malaysia yang akan ditetepkan dari masa ke semasa oleh Jawatankuasa. Alamat berdaftar dan tempat urusan Persatuan boleh diubah dengan syarat mendapat kebenaran Pendaftaran Pertubuhan terlebih dahulu.


Peraturan 2 DEFINISI

Perkataan Maksud

‘Ahli’ Ahli persatuan termasuk Ahli-ahli Biasa dan Ahli-ahli Bersekutu sebagaimana yang termaktub dalam perlembagaan.

‘Proton Edar’ Proton Edar Sdn. Bhd., sebuah syarikat yang didaftar di bawah Pendaftar Syarikat yang mengedar kenderaan buatan Malaysia.

‘Jawatankuasa’ Badan pentadbiran Persatuan yang tertinggi, yang diundi dan dilantik di bawah Peraturan 9 Perlembagaan ini.

‘Persatuan’ Persatuan Pengedar Proton Edar Malaysia (Proton Edar Dealers’ Association of Malaysia) (PEDA).

‘Pemegang Pemegang Amanah Persatuan.
Amanah’

‘Penaung’ Penaung Persatuan yang diundang oleh Jawatankuasa untuk memegang jawatan tersebut.

‘Setiausaha Agung’ Setiausaha Agung Persatuan dilantik di bawah Peraturan 9 Perlembagaan ini.
‘Wakil Ahli’ Wakil individu yang dilantik oleh ahli-ahli Persatuan.


Peraturan 3 OBJEKTIF-OBJEKTIF

3.1 Menyatupadukan perniagaan menjual produk yang diedarkan oleh Proton Edar dan mereka yang terlibat dalam perusahaan kereta untuk kepentingan faedah ekonomi ahli.

3.2 Memperjuangkan kepentingan hak ahli-ahli dari segi perusahaan atau perindustrian, ekonomi sosial dan undang-undang.

3.3 Menyelaraskan aktiviti-aktiviti semua ahli dan menyelesaikan jika diminta secara bertulis selisih faham yang timbul di antara ahli-ahli.

3.4 Membuat perhubungan dengan badan-badan lain yang berdaftar yang mempunyai tujuan-tujuan yang sama dengan Persatuan.

3.5 Menerbitkan majalah-majalah atau risalah-risalah yang berkaitan dengan perusahaan, menjual dan menyewa kereta, dengan syarat mendapat kebenaran terlebih dahulu dari pihak yang berkenaan, jika perlu.

3.6 Menganjur kelas-kelas dan apa-apa projek pelajaran berhubng dengan perusahaan kenderaan dan aktiviti-aktiviti berkenaan, jika perlu.

3.7 Membeli, menjual, meminjam, menggadai, memajak, menyewa dan membuat lain-lain urusan bersangkutan dengan tanah-tanah atau lain-lain harta bagi mencapai objektif Persatuan.

3.8 Menggalakkan ahli-ahli menubuhkan syarikat untuk menjalankan perniagaan sokongan yang berkaitan dengan perniagaan Proton Edar.

3.9 Menjalankan aktiviti berbentuk perniagaan dan ekonomi secara sah atas nama Persatuan dengan syarat semua wang dan keuntungan yang didapati oleh Persatuan ini hasil dari penyertaannya dalam mana-mana perniagaan akan digunakan semata-semata untuk melanjutkan, memajukan dan menjalankan tujuan-tujuan Persatuan ini dan tidak sebahagian pun daripada wang dan keuntungan itu akan digunakan untuk membayar faedah, keuntungan atau bonus kepada ahli Persatuan. Sungguhpun begitu, peruntukan ini tidak menghalang sebarang pembayaran yang dibuat dengan tujuan baik, untuk membayar gaji atau perbelanjaan atau kedua-duanya kepada sebarang ahli atau pekerja Persatuan ini dengan syarat mereka telah memberikan perkhidmatan kepada Persatuan.


Peraturan 4 KEAHLIAN

4.1 Persatuan ini mempunyai dua (2) jenis keahlian iaitu:-

(a) Ahli Biasa

Ahli Biasa terbuka kepada syarikat-syarikat pengedar atau wakil-wakil penjual yang berdaftar yang dilantik oleh Proton Edar di seluruh Malaysia.

(b) Ahli Bersekutu

Ahle Bersekutu terbuka kepada semua pengedar alat-alat pengganti Proton Edar secara francais dan semua pengusaha pusat service Proton Edar secara francais. Ahli Bersekutu tidak berhak mengundi dan diundi untuk memegang jawatan dalam Persatuan.

4.2 Syarikat-syarikat pengedar dikehendaki melantik dua individu yang sekurang-kurangnya memegangn jawatan pengurus di dalam syarikat ahli yang bertaraf warganegara Malaysia dan berumur 18 tahun ke atas sebagai wakil untuk menghadiri sebarang mesyuarat dan aktiviti-aktiviti yang dianjurkan oleh Persatuan.

4.3 Tiap-tiap permohonan untuk menjadi ahli hendaklah dihantar kepada Setiausaha Agung yang dikehendaki mengemukakan permohonan itu dengan secepat mungkin kepada Jawatankuasa untuk diluluskan. Jawatankuasa boleh mengikut budi bicaranya menolak sebarang permohonan tanpa memberi sebab-sebabnya.

4.4 Tiap-tiap pemohon yang yang permohonannya telah diluluskan seperti yang disebut di atas akan diterima menjadi ahli Persatuan setelah membayar bayaran masuk dan yuran tahunan seperti yang ditetapkan.


Peraturan 5 YURAN

5.1 Bayaran masuk keahlian dan yuran yang perlu dibayar adalah seperti berikut.

Yuran Tahunan RM300.00 RM150.00


5.2 Yuran tahunan hendaklah dibayar kepada Bendahari terlebih dahulu sebelum 31 hb. Januari tiap-tiap tahun.
5.3 Ahli yang membiarkan hutang yuran tertunggak selepas 31 hb Mac akan menerima surat peringatan yang ditandatangani oleh Setiausaha Agung atau wakil Setiausaha Agung, dan hak-hak sebagai ahli Persatuan akan digantung sehingga hutangnya telah dibayar.

5.4 Ahli yang membiarkan hutangnya sebanyak lebih dari jumlah yuran bagi dua (2) tahun dengan sendirinya terlucut daripada menjadi ahli Persatuan. Jawatankuaaa boleh mengambil tindakan undang-undang untuk menuntut segala tunggakan.

5.5 Jawatankuasa mempunyai kuasa uintuk menetapkan yuran masuk semula beserta dengan sebarang denda yang difikir munasabah bagi sesiapa yang telah membiarkan keahliannya terlucut disebabkan hutang

5.6 Yuran-yuran khas atau kutipan wang daripada ahli-ahli untuk perkara yang tertentu boleh dipungut dengan persetujuan Mesyuarat Agung ahli-ahli. Sekiranya ada ahli yang mungkir membayar wang yuran tersebut dalam tempoh yang telah ditetapkan, maka wang itu akan dianggap sama seperti hutang yuran tahunan.


Peraturan 6 PEMBERHENTIAN DAN PEMECATAN AHLI

6.1 Ahli yang ingin berhenti sebagai ahli Persatuan hendaklah memberi sekurang-kurangnya dua (2) minggu notis bertulis kepada Setiausaha Agung dan menjelaskan segala hutangnya

6.2 Mana-mana ahli yang gagal mematuhi perlembagaan Persatuan atau bertindak dalam cara yang mencemarkan nama baik Persatuan bolehlah digantungkan keahliannya untuk sesuatu tempoh sebagaimana yang difikirkan munasabah oleh Jawatankuasa.

(a) Sebelum menggantungkan keahlian, ahli berkenaan itu hendaklah diberitahu akan sebab-sebab bagi pemecatan atau penggantung tersebut secara bertulis.

(b) Ahli tersebut juga hendaklah diberi peluang untuk menerang dan membela dirinya secara bertulis tidak lewat dai 30 hari dari tarikh pergantungnya. Jika tiada pembelaan bertulis dibekalkan pada jawatankuasa dalam jangkamasa tersebut, pergantungan itu hendaklah dilaksanakan.

(c) Penarikan Pergantungan atau pemecatan ahli yang digantung hanya boleh dilakukan pada Mesyuarat Agung.


Peraturan 7 PERSATUAN BUKAN BADAN POLITIK

7.1 Persatuan ini bukanlah badan politik dan tidak boleh terlibat secara langsung atau tidak langsung dengan kegiatan politik atau parti politik.

7.2 Ahli yang bertanggungjawab membawa Persatuan terlibat secara langsung atau tidak langsung dalam politik atau parti politik adalah ditaksir sebagai gagal mematuhi Perlembagaan Persatuan dan tindakan akan diambil mengikut Peraturan 6.2 Perlembagaan ini.


Peraturan 8 MESYUARAT AGUNG

8.1 Kuasa tertinggi dalam Persatuan adalah pada ahli-ahli dalam Mesyuarat Agung. Keputusan atau resolusi yang diputuskan oleh ahli-ahli dalam Mesyuarat Agung adalah muktamad dan menjadi dasar kepada pentadbiran dan pengurusan Persatuan.

8.2 Pengelolaan Persatuan ini terserah kepada Mesyuarat Agung. Sekurang-kurangnya satu per dua (1/2) daripada jumlah wakil Ahli Biasa yang berhak mengundi atau dua kali jumlah Ahli Jawatankuasa, mengikut mana yang kurang hendaklah hadir dalam Mesyuarat Agung bagi mengesahkan perjalanan mensyuarat dan mencukupkan korum untuk mesyuarat

8.3 Jika korum tidak cukup selepas setengah jam daripada waktu yang ditetapkan untuk mesyuarat, maka mesyaurat itu hendaklah ditangguhkan kepada suatu tarikh (tidak lebih darpada 30 hari) yang ditetapkan oleh Jawatankuasa; dan jika korum tidak cukup selepas setengah jam daripada waktu yang ditetapkan untuk mesyuarat yang ditangguhkan itu maka berkuasalah ahli-ahli yang hadir menjalankan mesyuarat tetapi tidaklah berkuasa mengubah Perlembagaan.

8.4 Mesyuarat Agung Tahunan bagi Persatuan hendaklah diadakan secepat mungkin setelah berakhirnya tahun kewangan tetapi tidak lewat dari 31hb Mac pada tarikh, masa dan tempat yang ditetapkan oleh Jawatankuasa. Kerja-kerja Mesyuarat Agung Tahunan ialah:

(a) Menerima Laporan Tahunan Jawatankuasa berkenaan perjalanan Persatuan di dalam tahun lalu;

(b) Menerima Laporan Tahunan Bendahari dan Penyata Kira-kira yang telah diaudit bagi tahun yang lalu;

(c) Memilih ahli-ahli Jawatankuasa dan Pemeriksa Kira-kira bagi tempoh dua tahun yang akan datang (untuk tahun pemilihan sahaja); dan

(d) Menguruskan perkara-perkara lain yang dibentangkan di dalam mesyuarat itu.

8.5 Setiausaha Agung hendaklah menghantar kepada tiap-tiap ahli notis Mesyuarat Agung sekurang-kurangnya 21 hari sebelum tarikh yang ditetapkan untuk Mesyuarat Agung.

8.6 Notis Mesyuarat Agung tersebut semestinya mengandungi satu agenda termasuk salinan-salinan peringatan mesyuarat dan laporan-laporan, borang cadangan usul dan borang pencalonan untuk pemilihan Ahli Jawatankuasa (untuk tahun pemilihan sahaja) berserta dengan penyata kewangan Persatuan bagi tahun lalu yang telah diaudit. Salinan surat-surat ini juga hendaklah dibekalkan untuk dibaca oleh ahli-ahli di alamat berdaftar atau pejabat urusan Persatuan.

8.7 Pencalonan-pencalonan untuk pemilihan Ahli Jawatankuasa dan usul-usul secara bertulis untuk dibincangkan di dalam mesyuarat tersebut hendaklah disampaikan kepada Setiausaha Agung tidak lewat dari 14 hari sebelum tarikh mesyuarat.

8.8 Mesyuarat Agung Luarbiasa bagi Persatuan boleh diadakan,

(a) Bila difikirkan perlu oleh Jawatankuasa atau

(b) Atas permintaan beramai-ramai dengan bertulis oleh tidak kurang dari satu per lima (1/5) daripada jumlah Ahli Biasa yang berhak mengundi dengan menerangkan tujuan-tujuan dan srbab-sebab mengadakannya. Permintaan itu hendaklah dihantar kepada Setiausaha Agung Persatuan..

8.9 Mesyuarat Agung Luarbiasa yang diminta oleh ahli-ahli hendaklah diadakan pada satu tarikh di dalam tempoh tiga puluh (30) hari dari tarikh penerimaan permintaan mesyuarat itu.

8.10 Notis dan agenda untuk Mesyuarat Agung Luarbiasa itu hendaklah diedarkan oleh Setiausaha Agung kepada semua ahli sekurang-kurangnya 7 hari sebelum tarikh yang telah ditetapkan untuk bermesyuarat.

8.11 Peraturan 8.2 dan 8.3 di dalam Perlembagaan ini berkenaan korum dan penangguhan Mesyuarat Agung Tahunan boleh digunakan untuk Mesyuarat Agung Luarbiasa, tetapi dengan syarat jika korum tidak mencukupi selepas setengah jam dari waktu yang telah ditetapkan bagi Mesyuarat Agung Luarbiasa atas permintaan ahli-ahli, maka mesyuarat itu hendaklah dibatalkan dan dalam masa 6 bulan daripada tarikh itu Mesyuarat Agung Luarbiasa atas permintaan ahli-ahli dengan tujuan sama tidaklah boleh diadakan.


Peraturan 9 JAWATANKUASA

9.1 Satu Jawatankuasa seperti berikut yang dinamakan Pegawai Persatuan hendaklah dipilih dalam Mesyuarat Agung Tahunan dua (2) tahun sekali secara undi sulit:

- Seorang presiden
- Seorang Timbalan Presiden
- Tiga Belas (13) orang ahli Jawatankuasa Biasa

(a) Presiden hendaklah melantik dari ahli Jawatankuasa Biasa yang dipilih oleh Mesyuarat Agung untuk mengisi jawatan tersebut:

i. Dua (2) orang Naib Presiden,
ii. Seorang Setiausaha Agun,
iii. Seorang Bendahari Kehormat,
iv. Seorang Penolong Setiausaha Agung,
v. Seorang Penolong Bendahari Kehormat

(b) Jawatankuasa Eksekutif adalah terdiri daripada:-

i. Presiden,
ii. Timbalan Presiden,
iii. Kedua-dua Naib Presiden,
iv. Setiausaha Agung,
v. Bendahari Kehormat,
vi. Penolong Setiausaha Agung,
vii. Penolong Bendahari Kehormat
viii. Dua (2) orang ahli Jawatankuasa Biasa yang dilantik oleh Presiden dari ahli Jawatankuasa Biasa yang dipilih oleh Mesyuarat Agung
dan mempunyai tanggungjawab seperti yang terkandung di dalam fasal 9.6.

(c) Presiden berkuasa melantik empat (4) orang ahli Jawatankuasa Biasa dari mana-mana wakil ahli.

(d) Pemegang-pemegang jawatan Persatuan dan tiap-tiap pegawai yang menjalankan tugas pemerintah dalam Persatuan hendaklah terdiri daripada warganegara Malayssia



9.2 Pemilihan atau perlantikan ahli Jawatankuasa adalah tertakluk kepada
syarat berikut:

(a) Presiden dan Timbalan Presiden hendaklah terdiri daripada pengarah atau pemegang saham syarikat ahli.

(b) Semua Ahli Jawatamkuasa hendaklah terdiri daripada wakil ahli.

(c) Semua Ahli Jawatankuasa boleh dipilih atau dilantik semula apabila tamatnya tempoh perkhidmatan.

(d) Presiden Persatuan tidak boleh memegang jawatan lebih dari tiga (3) penggal [enam (6)tahun] secara berterusan.

(e) Ahli Jawatankuasa yang meletak jawatannya sebelum tamat penggalnya tidak dibenarkan bertanding semula untuk penggal yang berikutnya.

9.3 Jawatan seseorang Ahli Jawatankuasa akan dikosongkan sekiranya:-

(a) Ianya gila atau fikirannya tidak siuman,

(b) Ahli diwakilinya berhenti daripada menjadi Ahli Persatuan,

(c) Ianya tidak menghadir diri dalam mesyuarat-mesyuarat Jawatanakuasa sebanyak tiga (3) kali berturut-turut tanpa kebenaran daripada Presiden Persatuan,

(d) Ian memberi notis kepada Persatuan mengenai keinginannya untuk meletak jawatan,

(e) Ianya telah dilucutkan Jawatan oleh resolusi Mesyuarat Agung Persatuan,

(f) Ianya tidak lahi menjadi wakil ahli,

(g) Ia diisytiharkan muflis oleh mahkamah, atau

(h) Ia disabitkan dengan kesalahan jenayah oleh mahkamah.

9.4 Tanggungjawab Jawatankuasa Eksekutif ialah mengelola dan mengaturkan kerja-kerja harian Persatuan dan membuat keputusan atas perkara-perkara mengenai perjalanan Persatuan dengan tidak terkeluar dari Perlembagaan ini dan dasar umum yang ditetapkan oleh Mesyuarat Agung. Jawatankuasa Eksekutif tidak boleh membuat tindakan bertentangan dengan keputusan Mesyuarat Agung dengan tidak terlebih dahulu mendapat mandat daripadanya dan Jawatankuasa Eksekutif mestilah sentiasa taat kepada keputusan Mesyuarat Agung.

9.5 Jawatankuasa hendaklah bermesyuarat sekurang-kurangnya sekali di dalam tiga (3) bulan. Notis bagi tiap-tiap mesyuarat hendaklah diberikan kepada ahli-ahli sekurang-kurangnya lima (5) hari sebelum tarikh yang ditetapkan untuk mesyuarat tersebut. Presiden dengan bersendirian, atau tidak kurang dari satu per tiga (1/3) daripada Ahli Jawatankuasa bersama-sama boleh memanggil supaya diadakan mesyuarat Ahli Jawatankuasa pada bila-bila masa. Sekurang-kurangnya setengan daripada bilangan Ahli Jawatankuasa hendaklah hadir bagi mengesahkan perjalanan dan mencukupkan korum masyarakat.

9.6 Cara pengundian dalam mesyuarat Ahli Jawatankuasa ialah dengan mengangkat tangan untuk menunjukkan persetujuan dan setiap ahli berhak untuk satu undi sahaja. Keputusan adalah berdasarkan kepada undi yang terbanyak dan Pengerusi mesyuarat mempunyi undi pemutus dalam undian yang seimbang.

9.7 Seseorang Ahli Jawatankuasa yang mungkir menghadiri mesyuarat Jawatankuasa tiga kali berturut-turut tanpa alasan yang memuaskan akan disifatkan sebagai telah meletak jawatan di dalam Jawatankuasa.

9.8 Jika timbul perkara mustahak yang berkehendakan kelulusan Ahli Jawatankuasa dan mesyuarat Ahli Jawatankuasa tidak dapat diadakan, maka Setiausaha Agung bolehlah mendapat kelulusan daripada Ahli Jawatankuasa melalui pengedaran surat pekeliling. Syarat-syarat yang berikut hendaklah disempurnakan sebelum keputusan ahli Jawatankuasa boleh dianggap sebagai telah diterima.

(a) Masalah yang dibangkitkan itu hendaklah dibutirkan dengan jelas di dalam surat pekeliling yang dihantar kepada tiap-tiap Ahli Jawatankuasa;

(b) Sekurang-kurangnya setengah daripada bilangan Ahli Jawatankuasa mestilah menyatakan persetujuan atau bantahan mereka kepada cadangan itu; dan

(c) Keputusan hendaklah dengan undi yang terbanyak.

Sebarang keputusan yang didapati melalui surat pekeliling hendaklah dilaporkan oleh Setiausaha kepada mesyuarat Jawatankuasa berikutnya untuk disahkan dan dicatatkan di dalam peringatan mesyuarat.



9.9 Jika Ahli Jawatankuasa biasa meninggal dunia atau meletakkan jawatan, Presiden berkuasa melantik wakil ahli untuk memenuhi kekosongan itu.

9.10 Jawatankuasa boleh melantik pengurus dan kakitangan yang difikirkan perlu. Ia boleh menggantungkan atau melucutkan jawatan sebarang pengurus atau kakitangan kerana cuai di dalam pekerjaan, curang, tidak cekap, engkar menjalankan keputusan Ahli Jawatankuasa, atau kerana sebab yang difikirkan boleh merosakkan kepentingan Persatuan. Segala pengurus dan kakitangan akan melaporkan pekerjaan mereka kepada Setiausaha Agung dan diuruskan olehnya.

9.11 Jawatankuasa ini boleh menubuhkan Jawatankuasa-jawatankuasa kecil jika difikirkan perlu dan memberikan kewajipan-kewajipan khas kepada Jawatankuasa tersebut.

9.12 Jawatankuasa berkuasa untuk mengubah undang-undang kecil dan peraturan-peraturan yang tidak bercanggah dengan Perlembagaan Persatuan.

9.13 Jawatankuasa hendaklah memberi laporan tahunan berkenaan kegiatan-kegiatannya kepada tiap-tiap Mesyuarat Agung Tahunan.

9.14 Jawatankuasa Eksekutif berkuasa untuk menubuhkan Jawatankuasa Disiplin bagi meguruskan hal-hal disiplin ahli. Presiden hendaklah melantik salah seorang daripada Ahli Jawatankuasa sebagai pengerusi Jawatankuasa Disiplin.


Peraturan 10 KEWAJIPAN-KEWAJIPAN AHLI JAWATANKUASA

10.1 Presiden dalam masa menyandang jawatannya hendaklah menjadi pengerusi semua Mesyuarat Agung dan semua mesyuarat Jawatankuasa dan bertanggungjawab atas kesempurnaan perjalanan semua mesyuarat. Ia mempunyai undi pemutus dan hendaklah ia menandatangani peringatan-peringatan mesyuarat bila telah diluluskan.

10.2 Timbalan Presiden hendaklah memangku jawatan Presiden semasa ketiadaanya dan beliau diberi kuasa penuh Presiden sepanjang masa ia menjalankan tugas tersebut.

10.3 Setiausaha Agung hendaklah mengurus atau menjalankan kerja-kerja pentadbiran Persatuan mengikut Perlembagaan dan hendaklah ia menjalankan perintah Mesyuarat-mesyuarat Agung dan Mesyuarat-mesyuarat Jawatankuasa. Ia hendaklah hadir di dalam semua mesyuarat dan membuat catatan-catatan mesyuarat. Setiausaha Agung hendaklah dalam masa 60 hari dari tarikh Mesyuarat Agung Tahunan diadakan mengirimkan Penyata Tahunan Persatuan Kepada Pendaftar Pertubuhan sebagaimana yang dikehendaki di bawah seksyen 14 (1) Akta Pertubuhan, 1966. Ia juga bertanggungjawab menguruskan hal-hal surat-menyurat dan menyimpan semua dokumen kecuali kira-kira dan buku-buku kewangan. Di antara dokumen yang perlu disimpan adalah:-

(a) Buku daftar ahli yang mengandungi nama dan nombor pendaftaran syarikat, alamat perniagaan dan nombor telefon;

(b) Surat Perlantikan wakil ahli yang mengandungi nama dan nombor kad pengenalan wakil ahli yang dilantik.

10.4 Penolong Setiausaha Agung hendaklah menolong Setiausaha Agung menjalankan kerja-kerjanya dan memangku jawatan itu semasa ketiadaan Setiausaha Agung.

10.5 Bendahari bertanggungjawab berkenaan semua hal kewangan Persatuan Persatuan. Ia hendaklah membuat dan menyimpan kira-kira berkenaan semua perkara kewangan dan bertanggungjawab di atas kebetulannya.

10.6 Penolong Bendahari hendaklah menolong Bendahari Kehormat menjalan kerja-kerjanya dan memangku jawatan itu semasa ketiadaan Bendahari Kehormat.

10.7 Kewajipan-kewajipan Ahli Jawatankuasa Biasa hendaklah membantu Jawatankuasa menjalankan tugas yang diarah olehnya.

10.8 Naib-Naib Presiden hendaklah menjalankan tugas-tugas yang ditetapkan oleh Jawatankuasa dari masa ke semasa.


Peraturan 11 KEWANGAN

11.1 Tertakluk kepada peruntukan-peruntukan yang berikut bagi peraturan ini, wang Persatuan ini boleh digunakan untuk perkara yang berfaedah bagi menjalankan tujuan-tujuan Persatuan, termasuk belanja pentadbiran bayaran gaji, biayaan dan perbelanjaan pegawai-pegawai dan kakitangan yang bergaji dan upah memeriksa kira-kira tetapi walau bagaimanapun tidaklah boleh digunakan untuk membayar denda ahli yang telah dijatuhkan hukuman oleh mahkamah.

11.2 Bendahari atau Setiausaha Agung dibenarkan menyimpan wang runcit tidak lebih dari RM500.00 (ringgit Malaysia Lima Ratus Sahaja) pada sesuatu masa. Wang yang lebih daripada jumlah itu hendaklah dimasukkan ke dalam bank yang diluluskan oleh Jawatankuasa. Kira-kira bank itu hendaklah di atas nama Persatuan.

11.3 Segala cek atau kenyataan pengeluaran wang dari kira-kira Persatuan hendaklah ditandatangani bersama oleh dua (2) penandatangan samada Bendahari, Presiden atau Setiausaha Agung.

11.4 Perbelanjaan yang lebih daripada RM10,000.00 (Ringgit Malaysia Sepuluh Ribu Sahaja) dan tidak melebihi RM100,000.00 (Ringgit Malaysia Seratus Ribu Sahaja) kepada satu-satu penerima bagi sesuatu masa tidak boleh dibayar tanpa kelulusan majoriti dua pertiga (2/3) dari ahli Jawatankuasa dan perbelanjaan yang lebih daripada RM100,000.00 (Ringgit Malaysia Seratus Ribu Sahaja) bagi sesuatu masa tidak boleh dilakukan tanpa mendapat kebenaran Mesyuarat Agung terlebih dahulu. Perbelanjaan yang kurang daripada RM10,000.00 (Ringgit Malaysia Sepuluh Ribu Sahaja) bagi sesuatu masa boleh diluluskan oleh Presiden bersama Setiausaha Agung dan Bendahari.

11.5 Penyata Kewangan yang diterima dan dibelanjakan beserta timbangan kira-kira bagi setahun hendaklah disediakan oleh Bendahari dan diperiksa pleh Pemeriksa kira-kira yang dilantik mengikut Peraturan 12 Perlembagaan ini, dengan seberapa segeranya setelah tamat tahun kewangan. Penyata kira-kira yang telah diaudit itu hendaklah dikemukakan untuk kelulusan Mesyuarat Agung Tahunan yang berikut dan salinan-salinan hendaklah dibekalkan untuk makluman ahli di alamat berdaftar Persatuan.

11.6 Tahum kewangan Persatuan ini bermula dari 1hb Januari dan berakhir pada 31hb Disember tiap-tiap tahun.


Peraturan 12 PEMERIKSA KIRA-KIRA

12.1 Sebuah frima audit akan dilantik dalam Mesyuarat Agung sebagai Pemeriksa Kira-kira Persatuan. Mereka akan memegang jawatan selama dua tahun dan boleh dilantik semula di Mesyuarat Agung Tahunan.

12.2 Pemeriksa kira-kira yang dilantik adalah dikehendaki memeriksa Kira-kira Persatuan bagi setahun dan membuat laporan atau pengesahan untuk Mesyuarat Agung Tahunan. Ia / mereka harus juga dikehendaki (jika diperlukan) pada bila-bila masa oleh Presiden atau Jawatankuasa, memeriksa kira-kira Persatuan bagi mana-mana di dalam tempoh jawatan ia / mereka akan membuat laporan kepada Jawatankuasa.




Peraturan 13 PENGAMANAH

13.1 Tiga orang Pengamanah yang berumur lebih daripada 21 tahun bolehlah dilantik di dalam Mesyuarat Agung dan mereka akan berkhidmat selama yang dikehendaki oleh Persatuan. Semua harta tetap kepunyaan Persatuan akan diamanahkan kepada mereka dengan menandatangani suatu SURAT AMANAH (‘Deed of Trust’).

13.2 Pengamanah tidak boleh menjual, atau menarik balik atau menukar milik harta kepunyaan Persatuan dengan tidak mendapat persetujuan dan kuasa yang diberikan oleh Mesyuarat Agung.

13.3 Seseorang Pengamanah boleh dilucutkan daripada jawatannya oleh Mesyuarat Agung oleh sebab uzur kerana penyakit, tidak siuman, tidak berada dalam negeri atau kerana sebab lain yang menyebabkan ia tidak boleh menjalankan tugasnya atau pekerjaannya dengan memuaskan. Jika berlaku kematian, perletakan jawatan atau perlucutan seseorang Pengamanah maka kekosongan itu bolehlah dipenuhkan oleh Pengamanah yang baru dilantik di dalam Mesyuarat Agung.


Peraturan 14 PEMILIHAN JAWATANKUASA

14.1 Jawatankuasa hendaklah menubuhkan satu Jawatankuasa Kecil Pemilihan sekurang-kurangnya dua bulan sebelum Mesyuarat Agung Tahunan (Untuk Tahaun Pemilihan sahaja).

14.2 Tanggungjawab mereka adalah terdiri daripada:

(a) Mengelolakan dan mengawasi Pemilihan Jawatankuasa Persatuan.

(b) Menentukan semua syarat-syarat Pemilihan Jawatankuasa Persatuan dipatuhi oleh calon-calon yang bertanding.

(c) Mempastikan semua borang-borang pencalonan diisi dengan betul dan memenuhi syarat-syarat peraturan pemilihan ahli Jawatankuasa Persatuan.

(d) Mempastikan hanya wakil ahli Persatuan yang sah boleh mengundi dan menjadi calon atau menjadi pencadang dan penyokong kepada calon-calon.

(e) Mengira dan mengumumkan keputusan Pemilihan ahli Jawatankuasa Persatuan kepada Mesyuarat Agung Tahunan.

Peraturan 15 TAFSIRAN PERLEMBAGAAN

15.1 Di antara berlangsungnya Mesyuarat Agung, Jawatankuasa boleh mentafsirkan Perlembagaan ini dan Jawatankuasa boleh memutuskan perkara-perkara yang tidak terkandung di dalam Perlembagaan ini.

15.2 kecuali perkara-perkara yang bertentangan atau tidak selaras dengan dasar yang telah dibuat dalam Mesyuarat Agung, keputusan Jawatankuasa mengenai tafsiran Perlembagaan adalah muktamad jika tidak diubah oleh keputusan Mesyuarat Agung.


Peraturan 16 PENASIHAT / PENAUNG

16.1 Jawatankuasa boleh, jika difikirkan perlu, melantik mana-mana orang yang layak menjadi Penasihat / Penaung bagi Pertubuhan ini dengan syarat orang yang dilantik ini menyatakan persetujuannya secara bertulis.

16.2 Bekas Presiden boleh dilantik menjadi penasihat Persatuan hingga tahun pemilihan berikut.



Peraturan 17 LARANGAN

17.1 Permainan yang disebutkan di bawah ini tidak boleh dimainkan di dalam rumah Persatuan: Roulette, Lotto, Fan Tan, video games, Poh Peb Bin, Belankai, Pai Kau, Tau Ngau, Tien Kow, Chap Ji Kee, Sam Cheong. Dua puluh Satu, Tiga Puluh Satu, Sepuluh dan Setengah. Semua permainan dadu banker’s game, semua permainan video dan semua permainan yang bergantung semata-mata kepada nasib.

17.2 Persatuan atau ahli-ahlinya tidak harus cuba menghalang atau dengan apa cara juga mengganggu perniagaan atau harga barang-barang atau mengambil peranan di dalam gerakan kesatuan sekerja seperti yang diterangkan di dalam Akta Kesatuan Sekerja 1959.

17.3 Persatuan ini tidak boleh menjalankan kegiatan loteri sama ada dikhaskan kepada ahli-ahli atau tidak, atas nama Persatuan atau atas nama Ahli Jawatankuasa atau ahli tanpa kelulusan daripada pihak berkuasa berkenaan.

17.4 Faedah-faedah seperti yang diterangkan di bawah Seksyen 2 Akta Pertubuhan 1966, tidaklah boleh diberikan oleh Persatuan kepada mana-mana ahli Persatuan.

Peraturan 18 PINDAAN PERLEMBAGAAN

18.1 Perlembagaan ini tidak boleh diubah atau dipinda kecuali dengan keputusan Mesyuarat Agung. Permohonan untuk perubahan-perubahan atau pindaan-pindaan kepada Perlembagaan hendaklah dibuat kepada Pendaftaran Pertubuhan dalam masa 60 hari dari tarikh keputusan Mesyuarat Agung meluluskan perubahan atau pindaan itu dan hanya boleh dikuatkuasakan mulai dari tarikh perubahan atau pindaan itu diluluskan oleh Pendaftaran Pertubuhan.

18.2 Notis bertulis selama satu bulan perlu dihantar kepada semua ahli sekiranya hendak meminda sebarang fasal yang terkandung di dalam Perlembagaan ini.


Peraturan 19 PEMBUBARAN

19.1 Persatuan ini boleh dibubarkan secara sukarela dengan persetujuan tidak kurang daripada tiga perlima (3/5) daripada jumlah Ahli Biasa yang menghadiri dalam suatu Mesyuarat Agung yang dipanggil khas kerananya:

19.2 Sekiranya Persatuan hendak dibubarkan secara yang disebutkan di atas, maka segala hutang dan tanggungan Persatuan yang sah mengikut undang-undang hendaklah dijelaskan dan baki wang yang tinggal hendaklah diselesaikan mengikut cara yang dipersetujukan dalam Mesyuarat Agung berkenaan.

19.3 Kenyataan bersabit dengan pembubaran ini hendaklah disampaikan kepada Pendaftar pertubuhan dalam masa 14 hari dari tarikh pembubaran itu.



Peraturan 20.0 PENYERAHAN NOTIS ATAU / DAN DOKUMEN

20.1 Penyerahan sebarang notis kepada Persatuan seharusnya dibuat secara berikut:

(a) Dengan meninggalkan notis atau / dan dokumen di alamat berdaftar; atau

(b) Penghantaran melalui AR Daftar.


20.1 Penyerahan sebarang notis dari Persatuan kepada Ahli boleh dibuat secara berikut:

(a) Dengan meninggalkan notis atau / dan dokumen di alamat berdaftar; atau

(b) Penghantaran melalui AR Daftar; atau

(c) Melalui talian faks.

PERBEZAAN SKIM PELUPUSAN KERETA DIANTARA PROTON EDAR DAN PERODUA

1. PERSAMAAN SYARAT-SYARAT SKIM PELUPUSAN PROTON & PERODUA

a) Kenderaan pelbagai model dan buatan diterima tetapi mesti berusia 10 tahun atau lebih dari tahun diperbuat
b) Kenderaan harus berdaftar di Malaysia
c) Tiada hak milik dituntut oleh institusi kewangan atau tiada apa-apa cagaran kewangan
d) Tiada apa-apa saman, senarai hitam, perintah mahkamah, kes polis- Pelanggan harus mendapat kelulusan dari badan-badan kerajaan (JPJ/PDRM)
e) Mesti mempunyai cukai jalan yang sah


2. PERBEZAAN SYARAT-SYARAT SKIM PELUPUSAN

a) HAKMILIK.
PROTON mewajibkan pemilik sah kenderaan yang hendak dilupuskan, telah berdaftar lebih pada 6 bulan dan di rekodkan dalam kad pendaftaran kenderaan.
PERODUA meluluskan semua kenderaan berusia 10 tahun atau lebih (dari tahun diperbuat) dengan syarat pemilik yang direkodkan di kad pendaftaran kenderaan berdaftar sebelum tarikh 10 March 2009.

b) KEADAAN KERETA.
PROTON hanya menerima kereta yang boleh dipandu ke hadapan dan pandu undur (reverse) sekurang-kurangnya sejauh 20 meter.
PERODUA menerima kereta yang boleh dipandu masuk ke atas lori pengangkutan kenderaan.

c) PENDAFTARAN PERSENDIRIAN.
PROTON tidak membezakan kereta yang didaftar untuk kegunaan persendirian atau perdagangan.
PERODUA tidak menerima kenderaan yang didaftar di bawah pendaftaran perdagangan.

d) PINDAH-MILIK SKIM PELUPUSAN.
PROTON tidak mengeluarkan apa-apa kenyataan bertulis yang membenarkan pindah-milik RM5,000 dibawah skim pelupusan kereta kepada sesiapa kecuali pemilik berdaftar.
PERODUA membenarkan secara bertulis pindaan baucer dibuat kepada saudara terdekat seperti suami, isteri, bapa, ibu, anak-beranak dan adik-beradik.

e) JUMLAH YANG DITAWARKAN UNTUK PELUPUSAN KERETA.
PROTON menawarkan RM5,000 kepada pelanggan bagi melupuskan kereta lama untuk membeli sebuah kereta Proton yang baru walaupun harga pasaran kenderaan yang hendak dilupuskan melebihi atau kurang dari jumlah yang ditawarkan.
PERODUA pula menawarkan jumlah maksima sebanyak RM5,000 bagi pelupusan kereta. Jumlah maksima itu bergantung di atas jenis, model dan harga kereta baru yang hendak dibeli pada masa tawaran dibuat.

f) TEMPOH SAH BAUCER DISKAUN
Apabila skim pelupusan diluluskan, baucer RM5,000 akan dikeluarkan dan boleh ditebus untuk membeli sebuah kereta baru PROTON atau PERODUA.
Baucer PROTON sah laku untuk jangkamasa 3 bulan. Baucer mesti ditebus dalam tempoh sah laku itu, tetapi tempoh sah itu akan disambung jika jenis/model kereta yang dtempah masih tidak diperolehi.
Baucer PERODUA pula, hanya sah dalam tempoh 2 bulan sahaja dan PERODUA berhak mengenakan caj tambahan walaupun kereta yang ditempah tiada dalam stok.


3. SYARAT-SYARAT LAIN YANG HANYA DIKENAKAN OLEH PROTON SAHAJA

PERODUA tidak mengenakan apa-apa syarat lain selain dari syarat yang disebut di perenggan 1 & 2 di atas. Syarat-syarat lain yang HANYA dikenakan oleh pelanggan PROTON dan MESTI DIPATUHI adalah syarat Pemeriksaan fungsi dan Pemeriksaan alatan.

(a) Pemeriksaan Fungsian

i- Sistem pencucuhan yang aktif, enjin boleh dinyala dan dipadamkan tanpa bantuan bateri luaran (ignition).

ii- Pemanduan – kereta boleh dipandu ke hadapan dan pandu-undur sekurang-kurangnya sejauh 20 meter.

iii- Sistem Gear masih berfungsi dan dapat menggerakkan semua gear.

iv- Injak-injak (Pedal) , cekam (Clutch), brek (Brake) dan pemecut (Acclerator) masih berfungsi.

v- Brek Tangan ( Hand Brake ) masih ada dan berfungsi.

vi- Pemanduan tidak terjejas oleh kerosakan pada bahagian badan kereta, steering atau suspension.

(b) Pemeriksaan Alatan

i- Pintu – semua pintu masih ada dan lengkap.

ii- Hud (bumbung) – masih ada dan lengkap

iii- Papan pemuka (Dash Board) - masih ada dan lengkap

iv- Tempat Duduk (Seat) – masih ada dan lengkap

1. SIMILAR REQUIREMENTS FOR PROTON & PERODUA FOR CARS TO BE SCRAPPED

a) All vehicle types and models are accepted but all vehicles must be 10 years or older base on the manufacture year
b) Must be a registered vehicle in Malaysia
c) Must be free from any financial encumbrances or any other restrictions
d) Must be free from any summons, blacklist, court order and/or involved in any police case- customer to get clearance from the relevant authorities eg (JPJ/PDRM)
e) Must possess a valid non-expired road tax


2. CONTRASTING REQUIREMENT FOR CARS TO BE SCRAPPED.

a) OWNERSHIP. PROTON requires at least 6 months of ownership (as stated in the registration card) for the 10 years old car (from year of manufacture) to be scrap. PERODUA accept any 10 years old (from year of manufacture) car with rightful owner (as stated in the registration card) before the 10 March 2009.

b) RUNNING CONDITION. PROTON requires the car at all time, be able to be driven forward or in reverse for at least 20 metres. PERODUA only requires a basic and minimal running condition for purpose of placing the aged vehicle onto the car carrier.

c) PRIVATE REGISTRATION. PROTON did not specify if the vehicle to be scrap must be registered for Private and own used only but PERODUA will NOT accept any vehicle that is registered as a COMMERCIAL VEHICLE.

d) TRANSFER OF RM5,000 discount. PROTON did not explicitly allow the transfer of the RM5000 value for the scrap car but PERODUA explicitly allows the transfer to the next of kin (husband, wife, father, mother, children & siblings)

e) AMOUNT OFFERED FOR SCRAP CAR.
PROTON offers RM5,000 trade-in value for all cars of any make and model to be scrap irrespective of the market value of the car to be scrap.
PERODUA offer a maximum RM5,000 for scrap cars DEPENDING on the offer of the discount for the types and value of the new vehicle purchased at the particular period.

f) VALIDITY OF DISCOUNT VOUCHER
Once the scrapping is approved, PROTON allows the redemption of the Voucher within 3 months but will allow extension if the voucher is not redeemed due to non-availability of cars. PERODUA only allows 2 months for the voucher to be redeemed and reserves the right to impose any charges even if the delay was a due to unavailability of the requested car.


3. REQUIREMENT THAT IS ONLY APPLICABLE FOR PROTON CARS

Save as disclosed in Para 1 & 2 above, PERODUA does not impose any other condition or requirement. Other criteria and requirement that is ONLY APPLICABLE to PROTON are the FUNCTIONALITY and PARTS AVAILABILITY CHECK below. Vehicle for scrapping must pass both the two (2) checks.

(a) FUNCTIONALITY CHECK (only applicable for PROTON CARS)

i- Ignition system is active, engine is able to turn on and off without the need for external batteries
ii- Transmission Gear is functional and shifting of all gears are possible
iii- Pedals. Brake, Clutch and accelerator is functional
iv- Hand brake is available and functional
v- Drivability not affected by body entanglement, body steering, or suspension damage


(b) PARTS AVAILABILITY CHECK (only applicable for PROTON CARS)

i- DOORS. All doors are in-place
ii- HOOD. Available and in place
iii- DASHBOARD. Available and in place
iv- Seat. Are available and in place
v- INTERIOR PEDALS. Are available and in place
vi- BODY. Are in place and attached
vii- EXHAUST PIPE. Are available, intact and in place

DASAR PELUPUSAN - PANDUAN UNTUK MELUPUSKAN KERETA ANDA

1. Sebahagian daripada Rangsangsan Kewangan Ke-2 seperti yang diumumkan oleh Y.A.B. Perdana Menteri pada 10 March 2009 adalah untuk merangsang penjualan kereta dengan belanjawan tambahan sebanyak RM200 juta untuk disalurkan ke Tabung Pembangunan Automotif.

2. Diskaun sebanyak RM5,000 (sebahagian dari peruntukan RM200 untuk indudstri automotif), akan diberi kepada pemilik kereta yang akan menukar-beli sebarang kereta pelbagai model yang kenderaannya berumur sekurang-kurangnya 10 tahun untuk membeli sebuah kereta baru ( Skim Pelupusan ) ( Perenggan 54 – Menteri Kewangan Malaysia ).

3. Rentetan daripada pengumuman itu, Proton telah mengeluarkan satu Piawaian Prosedur Operasi pada 11 March 2009 akan tetapi skim pelupusan PERODUA masih belum bermula lagi. Kriteria untuk kelayakan pelupusan ini adalah ketat dan pada pendapat saya akan menggagalkan tujuan dan objektif utama untuk merangsangan penjualan kereta. Peruntukkan belanjawan untuk skim pelupusan ini akan mengakibatkan pembaziran bajet jika jualan kereta tidak dapat dipertingkatkan. Peruntukan untuk skim pelupusan ini adalah sebahagian dari RM200 juta yang disalurkan melalui Tabung Pembangunan Automotif.

4. Walau bagaimana, sebagai panduan kepada sesiapa yang berminat untuk menukar beli dan melupuskan kereta mereka yang telah berumur 10 tahun untuk membeli kereta Proton baru, berikut merupakan Piawaian Prosedur Operasi untuk membantu dan mendidik orang ramai bagi mengelak dari sebarang PENOLAKAN permohonan.

5. Pemilikan bagi kereta berumur 10 tahun (untuk dilupuskan) mestilah sekurang-kurangnya 6 bulan ke atas. Dengan itu, pemilik yang memiliki kereta berumur 10 tahun ke atas dan kurang dari 6 bulan tidak akan dapat melupuskan kereta demikian. Lazimnya, peringkat umur pemilik kereta 10 tahun ke atas adalah berumur 45 hingga 50 tahun. Walaupun mereka dapat melupuskan kereta, mereka cuma layak mendapatkan pinjaman (bagi pembelian kereta baru Proton) dengan tempoh pembayaran balik selama 3 hingga 5 tahun dan akan dikenakan pembayaran bulanan yang tinggi (berbanding dengan pembayaran bulanan bagi tempoh pembayaran selama 9 tahun) . Mereka mungkin tidak mampu untuk pembayaran bulanan yang amat tinggi untuk pembelian kereta Proton baru (jika pinjaman diluluskan).

6. Kereta yang hendak dilupuskan mestilah berumur 10 tahun ke atas dari tarikh diperbuat.

7. Pemilik yang sah mesti menanda tangani Borang JPJK1C , Jabatan Pengangkutan Jalan (JPJ) untuk membatalkan pendaftaran kereta demikian di bawah Perenggan 13 (2) , Akta 1952 Jabatan Pengangkutan Jalan.

8. Kereta yang akan dilupuskan MESTI MEMATUHI :
(i) Pemeriksaan fungsi
(ii) Pemeriksaan alatan.

9. Pemeriksaan Fungsian

(a) Sistem pencucuhan yang aktif, enjin boleh dinyala dan dipadamkan tanpa bantuan bateri luaran (ignition).

(b) Pemanduan – kereta boleh dipandu ke hadapan dan undur sekurang-kurangnya sejauh 20 meter.

(c) Sistem Gear masih berfungsi dan dapat menggerakkan semua gear.

(d) Injak-injak (Pedal) , cekam (Clutch), brek (Brake) dan pemecut (Acclerator) masih berfungsi.

(e) Brek Tangan ( Hand Brake ) masih ada dan berfungsi.

(f) Pemanduan tidak terjejas oleh kerosakan pada bahagian badan kereta, steering atau suspension.

10. Pemeriksaan Alatan
(a) Pintu – semua pintu masih ada dan lengkap.
(b) Hud (bumbung) – masih ada dan lengkap
(c) Papan pemuka (Dash Board) - masih ada dan lengkap
(d) Tempat Duduk (Seat) – masih ada dan lengkap
(e) Injak-injak dalaman ( Interior Pedals ) – masih ada dan lengkap
(f) Badan Kereta – masih ada dan lengkap
(g) Paip eksos – masih ada dan berkeadaan baik
(h) Lampu depan – satu lampu masih ada
(i) Lampu belakang – satu lampu masih ada
(j) Lampu brek – satu lampu masih berfungsi
(k) Tingkap – semua tingkap masih sempurna
(l) Brek tangan ( Hand Brake ) – masih ada

11. Setelah kedua-dua prasyarat telah dipatuhi, kereta itu mesti di periksa dan diluluskan oleh Puspakom serta lulus pencarian JPJ. Pemeriksaan Puspakom akan dikenakan caj minima sebanyak RM25 untuk satu kali pemeriksaan.

12. Setelah kedua-dua prasyarat tersebut dipatuhi, pembeli dikehendaki menyediakan dokumen-dokumen berikut ;
(a) Kad Pendaftaran Kereta yang asli (untuk diberi kepada Proton Edar Sdn Bhd)
(b) Borang JPJ K3 asli (Borang tuntutan pemilik yang telah ditanda tangan kepada Proton Edar Sdn Bhd)
(c) Borang JPJ K1C yang asli (untuk diberi kepada Proton Edar Sdn Bhd)
(d) Serahan kereta dan kunci kereta (kepada Proton Edar Sdn Bhd)

13. Proton Edar akan mengendalikan pemeriksaan PDRM, pemeriksaan ketaksolvenan dan pemeriksaan kastam untuk mendapatkan kelulusan baucer diskaun RM5,000 bagi pelupusan kereta.
14. Setelah baucer RM5,000 dikeluarkan untuk melupuskan kereta, pembeli mempunyai tempoh maksima 3 bulan untuk menebusnya.

15. Semua kereta yang telah diserahkan tidak boleh di tuntut kembali oleh pelanggan dan ianya akan dimansuhkan oleh JPJ.

1. Part of the Second financial stimulus announced by the Prime Minister on 10 March 2009 was to stimulate the automotive car sales with an additional budget of RM200million to the automotive development fund.

2. Within the RM200million budget, a discount of RM5,000 will be given to car owners, who trade in their cars of any make, which are at least 10 years old, for the purchase of new cars (scraping policy) (para 54- Minister of Finance).

3. Pursuant to the announcement, Proton came out with A standard operating procedure on 11 March 2009 BUT PERODUA had yet to start. The qualifying criteria for scrapping, in my personal opinion is an unnecessary red-tape that will defeat the sole purpose and objective to simulate the automotive sales and thus waste extensively part of the RM200million budget allocated for the automotive development fund.

4. However, for the public who are interested to trade-in and scrapped their 10 year old vehicle to buy a new Proton, the followings are guidelines and Standard Operating Procedures intended to assist and educate the interested party to AVOID any UNNECESSARY REJECTION.

When a customer brought along their 10 years old vehicle for application to scrap, the customer must bring along the following documens:

a) Photocopy of vehicle owner’s IC/Passport – must sight the original
b) Photocopy of buyer’s IC/Passport – (if different) must sight the original
c) Photocopy of registration card (must sight the original
d) Original Puspakom Identity Inspection – B2 (valid for 1 month from the date of inspection) (Puspakom inspection will only cost RM25)
e) Original JPJ search result
f) Original Approval Permit (AP)- for imported/CBU vehicle



5. Ownership of the 10 year old vehicle (to scrap) must be 6 months and above. Thus, those who owned the 10 year old car for less than 6 months will not be able to scrap those car. More often, the age bracket of the owner (of the 10 year old car) is between 45 or 50 years old, thus although they can scrapped their car, they may only qualify for loan (to buy a new Proton car) with a maximum duration of 3-5 years that bear a higher monthly repayment (compare to the monthly repayment for 9 years loan duration). They may not be able to afford the monthly repayment to buy a new Proton (that is if the loan was approved).

6. The car to be scrap must be 10 years and above from the manufacturing date.

7. Rightful owner must sign Road Transport Department (JPJ) form JPJK1C to cancel the registration of the said vehicle under Paragraph 13(2) of the Road Transport Department Act 1952

8. Sales representative must inspect the said Vehicle condition before accepting the car under the scrapping policy. The car to be scrapped MUST PRINCIPALLY COMPLY TO (i) FUNCTIONALITY CHECK
(ii)PARTS AVAILABILITY CHECK
If the two (2) pre-condition chck as outlined below are fulfilled, a redemption Voucher RM5,000 will be issued irrespective of the market value for the car. If customer agrees to participate in this scheme, sales representative must advice the customer on the requirement for eligibility of the Scheme and the required documents to be submitted.


9. FUNCTIONALITY CHECK:

11. The customer may inspect the vehicle and conduct a JPJ search before or after approaching any Proton Showroom. However, if the vehicle has not been inspected, once the above 2 pre-condition are complied, then the vehicle MUST be inspected and approved at Puspakom and pass the JPJ search before the application can be submitted. The Puspakom inspection will cost the buyer a minimal RM25 per inspection.

12. Once the above two pre-condition are complied, buyer need to provide the following documents:

(a) Original Registration Card (Hand-over to Proton Edar Sdn Bhd)
(b) Original JPJ K3 Form (Ownership-claim form duly signed to Proton Edar Sdn Bhd)
(c) Original JPJ K1C form (Hand-over to Proton Edar Sdn Bhd)
(d) Hand-over the vehicle and car key (to Proton Edar Sdn Bhd)

13. Proton Edar will then conduct PDRM inspection check, insolvency check and custom check for the RM5,000 discount voucher approval to scrap the vehicle.

14. Once the RM5,000 voucher is issued to scrap the car, buyer has a maximum 3 MONTH to redeemed the voucher.

15. All vehicle surrendered cannot be claimed back by customer and will be de-register from JPJ.

WAKIL PENGEDAR PROTON YAKIN BALIK MODAL DENGAN EXORA

PROTON EXORA PENENTU UNTUNG RUGI, HIDUP ATAU MATI PENGEDAR-PENGEDAR PROTON


April 2009, Kuala Lumpur. “ Purata keseluruhan jualan bulanan kereta setiap pengedar sekarang, telah menunjukkan peningkatan dengan mencatatkan jualan sebanyak 35 buah kereta dari pelbagai model berbanding dengan 28 buah kereta sebelum ini. Untuk mencatatkan keuntungan (break-even), setiap pengedar perlu menjual sekurang-kurangnya 40 buah kereta sebulan bagi pengedar di Lebah klang atau 35 kereta bagi pengedar di bahagian pendalaman. Pelancaran kereta baru Proton Exora akan dapat meningkatkan purata jualan untuk mengelak dari kerugian” kata Armin Baniaz Pahamin selaku Pemangku President Persatuan Pengedar Proton Edar Malaysia (PEDA).

1. Proton Exora merupakan penambahan model yang ke-sembilan bagi semua model-model kereta dijual oleh Proton. Buat masa ini, terdapat lapan model yang berada di pasaran merangkumi Proton Satria Neo, Proton Waja, Proton Gen2, Proton Persona, Proton Arena (diatas permintaan), Proton Perdana, Proton Savvy dan Proton Saga. Pada masa ini, hanya Proton Saga dan Proton Pesona sahaja yang laris dijual.

2. Dengan kualiti yang bagus dan struktur harga Proton Exora yang berpatutan, kami yakin bahawa kereta baru ini akan mendapat sambutan yang baik dan akan meningkatkan rataan jualan kereta Proton dengan sekurang-kurangnya 30%.

3. Proton Exora bersama dengan Proton Saga dan Proton Persona dijangka akan menyumbangkan sebanyak lebih 80% dari jualan kereta Proton keseluruhan. Berdasarkan jangkaan pengeluaran bulanan kereta Proton Exora, setiap cawangan dan pengedar akan diperuntukkan sekurang-kurangnya 10 buah kereta Proton Exora setiap bulan.

4. Pengeluaran kereta sebanyak 10 kereta setiap pengedar akan menjadi asas kepada tempoh menunggu (waiting list) penghantaran kereta pelanggan. Pelanggan yang telah membuat pesanan sebelum pelancaran hari ini akan diberi keutamaan penghantaran. Setakat ini, kami telah menerima lebih dari 2000 pesanan bagi kereta baru Proton Exora di seluruh Negara walaupun tanpa melihat kereta baru tersebut.


5. Peningkatan jualan kereta (dari purata jualan 28 kereta kepada 35 kereta sebulan setiap pengedar) bagi setiap pengedar juga berdasarkan peningkatan peratusan kelulusan jumlah pinjaman sewa beli pelanggan. Kelulusan pinjaman sewa beli bagi pembeli kereta Proton pada awal tahun adalah kritikal iaitu 30% kadar kelulusan atau hanya 3 kelulusan daripada setiap 10 permohonan pinjaman sewa beli yang dibuat . Kadar peratusan kelulusan buat masa ini telah meningkat dari 30% ke 50% akan tetapi PEDA percaya kadar kelulusan ini masih boleh diperbaiki.

6. Walaupun terdapat peningkatan dari segi jualan kereta, tetapi keuntungan yang diperolehi dari hasil jualan setiap kereta semakin merosot. Ini berikutan amalan dari segelintir pengedar yang tidak bertanggung jawab. Pengedar demikian telah menawarkan komisyen yang lebih tinggi kepada jurujual dari pengedar yang lain untuk mendapatkan pelanggan. Ini bertentangan dengan kadar komisyen yang telah ditetapkan oleh Proton Edar dan mewujudkan situasi dimana tawaran komisyen yang tertinggi akan membolot majoriti jualan dan seterusnya mengakibatkan kerugian yang besar kepada pengedar-pengedar yang lain (disorderly trade practice)

7. Pengedar seharusnya bersaing dengan Perodua atau pesaing yang lain dan bukannya diantara pengedar-pengedar Proton sama-sendiri. PEDA menyeru kepada semua pengedar Proton supaya memberhentikan segala amalan-amalan yang merosakkan dan mencemarkan seluruh rangkaian pengedar. Ia tidak memberi apa-apa manfaat atau merosakkan semangat keakraban dan berkumpulan. PEDA terikat dengan perlembagaannya untuk melindungi semua pengedar Proton dan juga orang awam, tidak akan teragak-agak untuk menyokong dan mencadangkan kepada Proton Edar pemecatan pengedar-pengedar yang tidak senonoh ini terutama apabila Yg Bhg Dato Nadzmi Salleh, Pengerusi Proton berkali-berkali menekan kan untuk mengurangkan jumlah bilangan pengedar.

8. Pengerusi Proton dan pihak pengurusannya serta PEDA telah bersetuju untuk memberi keutamaan memecat pengedar yang mengamalkan perbuatan tidak senonoh itu (disorderly trade practice).

9. PEDA menggesa orang ramai supaya mengunjungi bilik pameran atau pejabat Proton yang sah untuk membuat sebarang pembayaran pendahuluan. Orang ramai diminta tidak menyerahkan bayaran kepada mana-mana jurujual di luar bilik pameran dan sentiasa mendesak untuk mendapatkan resit rasmi yang mempunyai logo Proton juga nama pengedar yang sah serta alamat dan nombor untuk dihubungi kembali.

10. Skim Pelupusan Kereta yang diperkenalkan tidak memberi apa-apa kesan kepada jumlah jualan kereta baru Proton walaupun terdapat banyak pertanyaan. Ini mungkin punca dari syarat-syarat polisi yang ketat untuk melupuskan kereta yang berumur lebih dari 10 tahun itu. Hanya kereta yang lebih dari 10 tahun dan mempunyai cukai jalan yang sah, berkeadaan baik (road worthy condition) dan lulus pemeriksaan Puspakom akan diluluskan di bawah skim pelupusan. Skim pelupusan ini diperkenalkan untuk mendorong dan mempertingkatkan jualan kereta ekoran dari kemelesetan ekonomi. Peruntukkan dana bagi skim pelupusan kereta ini akan terbuang dan objektif untuk mendorong penjualan kereta juga tidak akan tercapai dengan adanya syarat-syarat ketat yang tidak munasabah untuk melupuskan kereta yang sudah berumur 10 tahun.

11. Rangsangan kewangan ke-dua (2nd financial stimulus) yang awal diumumkan masih belum memberi apa-apa kesan lagi kepada jualan kereta Proton, operasi perniagaan pengedar atau pada industri automotif.

12. Orang awam masih lagi dibebankan dan tidak dapat menjual kereta mereka hasil dari kadar penilaian yang rendah. PEDA telah mencadangkan kepada pihak Kerajaan untuk menubuhkan satu perbandanan yang berasingan dari bank untuk membuat nilaian ke atas kereta terpakai di Malaysia seperti di Negara-negara maju yang lain. Penilaian ke atas kereta terpakai seharusnya mempertimbangkan polisi kerajaan yang melibatkan tempoh pinjaman yand diluluskan, tempoh pembiayaan, keadaan kereta termasuk aksesori, status sejarah kemalangan, catatan pembatuan (mileage) jumlah pemilik, rekod servis dan penyenggaraan serta rekod jenayah dan penipuan. Pelbagai faktor harus dipertimbangkan bagi penilaian ini. Ianya akan mengurangkan beban orang awam dan akan meningkatkan jualan automotif.

PROTON DEALERS CONFIDENT OF BREAKING-EVEN WITH NEW PROTON EXORA IN LINE UP

APRIL 2009, KUALA LUMPUR. “The average monthly car sale per dealer had improved from 28 car sales to 35 cars of various mix model variance. Urban dealers need to sell at least 40 car sales per month to break-even. The launching of Proton Exora today, will increase the average car sales per dealer by 10 additional units per month to break-even.” said Armin Baniaz Pahamin, Acting President Proton Edar Dealers Association Malaysia (PEDA).

1. The new Proton Exora will be the 9th addition to Proton range of cars. Currently there are 8 model variances under Proton brand, namely Proton Satria Neo, Proton Waja, Proton Gen2, Proton Persona, Proton Arena (base on request), Proton Perdana, Proton Savvy and Proton Saga. Currently, the most sellable model are only Proton Saga and Proton Persona.

2. Given the quality and the price structure of the new Proton Exora, we are confident the new car will be well received and will increase Proton average car sales by at least 30%.

3. Proton Exora together with Proton Saga and Proton Persona is expected to contribute 80% of total Proton sales. Based from the expected monthly production, every branches and dealers will be allocated at least 10 Proton Exora per month.

4. This will be the basis for customer’s waiting list. Customers that booked prior to the launching today will be given the main priority for deliveries. Todate, we received more than 2000 bookings for the new Proton Exora nationwide without the customer sighting the new car.

5. The increase in total car sale per dealer, were attributed to the improvement in customer’s hire-puchase loan. Proton car buyer approval rate was critical at 30% approval rate or only 3 approvals for every 10 application for hire-purchase loan. Now approval rate has improved from 30% to 50% but PEDA believe the percentage of approval can be further improved.

6. Although the monthly average number of car sold per dealer has improved, but the profit per car sold is declining due to unhealthy practices by some unscrupulous dealers. Some irresponsible dealers offered higher commission to other dealers’ sales personnel to bid for customers. This is in adverse to the allowed commission fixed by Proton Edar and created an inevitable environment of highest bidder wins that resulted in major loss to dealers.

7. Dealers should be competing with Perodua or other competitors and should not be competing with other Proton own dealers. PEDA urge all Proton dealers to stop all form of disorderly trade practices that had damage the network and is not in the spirit of camaraderie and teamwork. PEDA is bounded by its constitution to protect all Proton dealers as well as the public and will not hesitate to recommend (to Proton Edar) for termination any dealers that are involved in any disorderly trade practices especially since Yg Bhg Dato Nadzmi Salleh, Proton Chairman had specifically and explicitly reiterate to rationalize the number of dealers.

8. Proton Chairman and management together with PEDA had agreed the first priority for any termination will be on the dealers practicing disorderly trade practices.

9. PEDA urge the public to visit and only pay for booking fees at the Proton authorized showroom/office and avoid making any payment to any sale representative outside the Proton authorized showroom and always insist for a duly signed valid official receipt bearing Proton logo and the authorized dealer’s name, address and contact number.

10. The scrapping policy introduced had negligible effect on new Proton car sales although there were a lot of inquiries. This may be due to the stringent qualifying requirement that requires all cars for scrapping to possess a valid road tax, in road worthy condition and pass the Puspakom inspection. The scrapping policy was introduced to spur the automotive sales during the current recession. The budget allocated for the scrapping policy will be a waste and the objective to spur the automotive sales will not be achieved with the unnecessary stringent requirement to scrap the 10 year old cars.

11. The 2nd financial stimulus that was announced earlier does not have any material affect yet on Proton car sales, dealer’s business operation or the automotive industry.

12. The public is still burden and are not able to dispose their existing car due to the low valuation. PEDA had proposed for the Government to establish a body that is independent from the bank to value the second hand car in Malaysia similar to other developed nation. The second car valuation should take into consideration the government policy in Bank’s margin and duration of finance, physical condition of the vehicles including any added accessories, accident history status, mileage of the vehicles, number of ownership, service and maintenance record and any history of criminal or fraud. There are various other factors that can be considered into the official valuation. The public will be less burden and the automotive sales will be in stronger with the establishment of the independent body.

“THE SECOND FINANCIAL STIMULUS DID NOT ADDRESS THE CURRENT PROBLEMS OF THE AUTOMOTIVE SECTOR”

MARCH 2009, KUALA LUMPUR. “PEDA is grateful the government recognized the importance of the automotive sector with the allocation of RM200m to the Automotive Development Fund. However, PEDA appeal for transparency and a fair distribution to the respective value chain in the network.” said Armin Baniaz Pahamin, Acting President Proton Edar Dealers Association Malaysia (PEDA).

1. Every stakeholder in the value chain from the manufacturer, distributor, vendor and the dealers made up the automotive eco system and are equally important. Any failure in the value chain will destroy the automotive eco-system.

2. .The RM200m allocation will support and strengthened the automotive eco system but it will not resolve the main issue facing the industry.

3. There are two major issues facing the automotive industry. The main issue is the Bank’s credit risk scoring system that is becoming more stringent for car buyer to obtain loan approval. Currently, car buyer rejection rate is still alarming at the highest 60% from total hire purchase loan submission.

4. The second major issue is the Low valuation of second hand car market. Second hand car valuation is significantly less than customer’s car existing balance loan amount especially if the car is still within the first 5 years of financing. During recession, majority cannot afford to service their monthly car loan installments and they cannot even sell their car (without having to pay the bank for the balance loan). This resulted in their cars being repossessed and they being declare a bankrupt. The low second hand car valuation also hinders customer from trading in their existing car. 90% of new car buyer will want to trade-in their existing car and 80% of customer cannot fetch a fair price to trade in their car, which then lead to various cancellations of new bookings.

5. Banks are profit making organization similar to other businesses. If they value car buyer at a higher risk now given the recession, they will continue to reject loan submission and this will further affect the automotive car sales.

6. PEDA proposed part of the budget allocated to be utilized for guaranteeing the banks on any increase in the aggregate NPL given the current economic condition. The government guarantee will ensure a less stringent and more flexible financing that can spur the overall automotive sales.

7. Government must establish a body that is independent from the bank to value the second hand car in Malaysia similar to other developed nation. The second car valuation should take into consideration the government policy in Bank’s margin and duration of finance, physical condition of the vehicles including any added accessories, accident history status, mileage of the vehicles, number of ownership, service and maintenance record and any history of criminal or fraud. There are various other factors that can be considered into the official valuation. The public will be less burden and the automotive sales will be in stronger with the inception of the independent body.

8. The RM5b Working Capital Guarantee Scheme should also be made available to Proton dealers whom are badly affected from the dropped in automotive sales. Most of Proton dealers shareholder equity are below RM5m

9. The tax refund for current year losses to be carried back to the immediate preceding year taxable profit will only provide some cushion to minority dealers. The majority dealers had already suffered losses since the previous years.

10. The auto scrapping policy for vehicles above 10 years old to be traded-in for the purchase of new Proton and Perodua cars may spur some interest but will not increase car sales significantly especially with the difficulty in getting customers loan approved.

11. Most 10 year old car owner will not trade in their vehicle for RM5,000 as they would have already fully paid the car loan. If they trade in the car to buy a new proton or a Perodua, they will end-up with an average monthly loan repayment of RM500 for 9 years, if they can get their loan approved. Given the current economic condition, it is doubtful the more than 10 years old car owners can afford the monthly loan repayment. However, the scrapping policy will be beneficial to the industry in the long run.

12. Unless the part of the 2nd financial stimulus is utilized to address the two main issues affecting the automotive industry namely the high loan rejection rate as well as the valuation of second hand car market, it is doubtful the second fiscal stimulus will spur the automotive sector.

Its Saturday night..!! i should be singing my heart out at the home karoeke room upstairs having invested in a state of the art karoeke system or unwinding enthusiastically on a DVD-thon or perhaps just laze in bed hopelessly.... but here i am writing yet.. another tag-notes on Facebook... a good FB etiquette sort of speak... thanks to my cousin SYERRY & FAZ. Although i could just ignore when tagged for notes like this, i decided to reply but on my blog instead... didnt want to be too rude and nonetheless, the blog needs to diverse away from the more serious government, Proton, Politics and current issues affecting our daily lives. The title of the tag-note is '2 THINGS'. I kind of over-done the questions with an essay assignment-sort of answer.

A. TWO NAMES YOU ARE CALLED THAT ARE NOT YOUR REAL NAME:

My real name is ARMIN BANIAZ.... unlike other names that bears a translated meaning of other languages (mostly arabic) or religion associated but Armin Baniaz is really a self-created name...... A.R.M.I.N.... AR is actually my granddad initial Abdul Rajab and MIN is my dad's abbreviated name PAHAMIN. BANIAZ is truely my mum's name read from the back ZAINAB. Although my name was not from my creativity but that of my father but I love my name. My name is perfect... especially when it is only ME that appeared when Armin Baniaz is Google. but what i am less fascinated, is the pronunciation by ‘oghe kelatae’ (a State in the East Coast Malaysia, Kelantan) being a kelatae-nis (kelantanese). The dialect pronounced my name as AHMENG BARNIAH...... over and above the dozens of other nicknames or commercial names being conferred upon by siblings, friends and relatives... the two other than the real names are:

1. YAZ (made popular by my mum), pronounced as iyah by Kelantanese dialect
2. Bonenzo (made popular by my sista Ta)

B. TWO THINGS YOU'RE WEARING NOW:

Now, in a cold air-condition room, on Saturday, I should be in pyjamas or naked under the duvet but here i am writing Facebook tag-notes on my do-nothing night..... a default & a must wear on all occasion including now will be:

1. Tag Heuer spec that is now my daily wear having busted my eye Cornea after using an expired contact lenses!!!

"It does not need much brain power so just give this a go"... and here I am cracking my head to shortlist the 'only' 2 names or things to write... everything I do is a favourite to me.. or else i will not be doing it at all..... but the best of the favourite things that I do is..

D. TWO THINGS YOU WANT VERY BADLY AT THE MOMENT:

God forbid.... there are so many things that I will die to have, especially now.... but currently, the most crucial is the extra hours to complete this tag-note.. ;-) :-p and still have my normal hours to 'do-nothing'.. Saturday is supposedly a day without obligation... henceforth, i badly need:

Ironically, i have 5 siblings and countless relatives when my grandad's real fulltime job is making love, babies and getting married and re-married.. i have too many cousins and relatives that even i cannott remember some of them. With so many siblings, relatives and friends.... I actually have problem thinking of 2 names that would fill out and return the tag-notes.. All of them including beloved yours truely are very shy to write and alot less sporty.. so the only two that i think will correpond and is a polished FB etiquette are:

Yes.. the two person that i cant say NO to return the tag.. I always thought that lawyers are handy in writing but if I take sampling of 10 lawyers which comprise half of my siblings and most of my circle of friends, almost 100% sampling of the 10 known sibling and friend lawyers only writes affidavits, SDAs and statutory declarations. None, would actually participate in blogs or facebook tag-notes.

WHEN TODAY IS MORE THAN JUST A BIRTHDAY...

When today is more than just a birthday.... (1 March 2009)

I sat alone in my study room ignoring the dozens of work emails and sms’s received that I would otherwise reply. My maid brought my hot coffee. The time now is 430 in the morning. I sipped the hot coffee and was wide awake. It is routine to start the day early with morning gym or cardio exercise, but today, I sat quietly thanking Allah swt for yet, another year to see my birthday.

A birthday seemed so much commercialized akin of a shopping day for presents instead of heart-fully celebrating the special meaning of the day. Such capitalist our society has evolved.

I am blessed to have such a darling family, siblings and friends… whom lavished me with endless gifts and presents. Every year, dad happily give designer watches, 5 figure cash or whatever that is desired as a birthday present whilst mum would shower those designer diamonds, jewels and any other luxurious items. Birthday gifts from siblings and friends will usually replaces half of my wardrobe with new designer clothing, belts, shoes etc…. I appreciate and am thankful for all the past gifts and presents from family and friends but this year, 2009 as part of my New Year resolution, I WON'T accept any presents and gifts for my birthday. Instead and indeed, I am blessed and indebted beyond word for the love, support, wonderful relationship and friendship that I have. My appreciation for family and friends are beyond presents and gifts however much the value is.

Particularly for my birthday, I am thankful to my parent (not for the watches, diamonds and wealth) but for having the right genetic recipe in giving birth to me..

My dad has been my pillar in strength, the shoulder when I am in need and the comfort and security when I am lost (quite frequently in the past). Raising a son like me (oh god) is far from challenging (almost impossible) but you never gave up (though I am sure you must be cursing at time). I have been both a pain with endless childhood rebels and notoriety as well as endless sickness. You sacrifices everything (except for your new ASTON martin DB9) and make me the person I am today. Tirelessly, you gave your love, support and the confidence in me to proceed with my dream. Having that from you is the best birthday gift any son can get. It means more than any designer watches or wealth...and car.

My mom, no matter how fat, sick, bad, naughty, disgusting and obnoxious that I can be… will always see me as the most handsome, an angel and the perfect son (though I don't think she is wrong..hehee). When I was sick and in ICU isolation for many months, you stood by my bed without leaving me for a second or a day (for the whole of 3 months in a solitary confinement of the ICU room!).. you were beside me every day and every moment. As I grew up, I became rebellious and had at time even neglected and was even rude at you taking for granted the love of a mother.. but you never sulk nor took any offense. Instead, you showered me with more love and care. This is a priceless gift from a mother and values more than any diamonds and jewels. Your love and care is a lifetime gift that I ever wanted, not diamonds and jewels. I am grateful to Allah swt for having another year with you as my mother.

With my medical history, and both dad and mum’s old age, we sometimes jokingly bet who will ‘go’ first….

My lifetime soul mate.. my one and only darling... Thank you for the non-exhaustive ideas to learn and cook various recipes for my everyday meal. Being me, although I am not fussy with food but the perks of being me comes with cholesterol, diabetic, gout and stone to say the least, over and above the blood type diet that I strictly follows. Thus limiting the choices of food that is available, but you never gave up and kept changing the menu (within the limitation) so i don’t get bored (though at times, maybe you purposely wanted me to be fat haa! :-p). Although we are very open and liberal in many ways, you always care for our pride and dignity. Your beautiful voices when singing cheered me everytime I am down and your endless encouragement (and nagging!!) in health motivates me to wake up as early as 4am to exercise everyday. I appreciate your endless and tireless care for your physique and look to always beautify yourself for me. Your patience and understanding coping with my mood and temperament kept us strong and happy together. you are perfect in every sense and it is an eternal gift that any man can ever prayed for. I am a lucky man.. the perfect you is all that I ever wanted for my birthday….

Chempaka Emalin, my one and only older sister is nothing but a perfectionist and systematically meticulous (sometimes absurdly :-p) with the smallest details that she is. For as long as I can remember, she will never fail to be punctual (at the stroke of midnight) with greeting cards, branded and boutique presents on my every year birthday although I have to admit that sometimes (or always rather), I never gave her any compliments, birthday cards or any present for many years (sssh.. she may not remember and she is not on FB or internet). BUT she, being the caring sister that she is, NEVER took offense, held any grudges and continued to generously lavish me with support, care and branded gift. The generosity, care and responsibility, is a gift that I can never repay….suffice with being what you are, I don’t need any other presents and gifts…

Azhar Sulaiman although a brother- law but is the elder brother I never had.. Since the day I knew you, until the day you married my sister, you have been very accommodative with the temperament of my family, especially me, may not be easy but your patience, endless compromise and understanding make you the best older brother I can ever dream to have. Thank you and that is indeed the best present from you………. No other material gift can ever be a substitute.

Melor Edina almost a twin sister to me (being the same age for 3 days every year and is less than a year apart from me) is the sister that I am most over-protective during childhood. Although she had to live a hard life with an over-protective brother, restricting her every movement but she had never complained (actually she had no choice.. :-D). Truthfuly, rhiza is the only real boyfriend you ever had.. and you married him (unless behind me, you happily dated other guys Grrr). In fact, she is ever-forgiving and is always there everytime I am down although my problem was never spoken to her. She knew (akin of a twin sister feeling my pain) and would appear at my house in a sudden. Thank you for being such a darling and for always been there for me. Indeed that is the best ever present from you.

Rhiza Ghazi, is more a family than ever an in-law. Having you as part of the family is a great comfort. Having a responsible brother that is always protective and family-centred has gained every sibling's trust. you being you… is already an invaluable gift than any material present can ever replace. Although I don’t accept any present, I will still claim the RM1,000 betting if I win the 6-pack contest.. kikiiii Thank you brother.

Teratai Edithy (Dr, Puan, Mummy, Mekta) is indeed the best Koya’ing partner anybody can have. Your forever concern for every sibling and friends’ welfare, makes your career as a doctor the best choice… and also a good mummy. I am very proud to have you as a sister. Your endless concern, care, love and ‘gossips’ is the best birthday gift i ever wanted from a sister. No matter how good London sale is, please shop for yourself and not for me..

Wawa Asari is a dream in-law any brother can imagine. Being forever helpful, fun, humble, adaptable to all kind of temperament and the best partner to sing out of tune karoeke makes you a great brother. That is in itself the best birthday present I can get..

Rose Emini (baby sis, chik, mek cewi) although you were 70kg.. you are still my baby sister. You are the baby-iest sister and my life saviour… you were 7 years old... although you had no choice but you voluntary and happily sacrifice your bone marrow (for my Bone Marrow Transplant) when you knew I was dying. That meant the world to me. Your patience, undivided love and dedication is the best gift you have given me beyond any other present.. thank you

Amnan Bazli, my one and only brother…… at 23 years old.. is still acting a baby.. the ‘bongsu’ syndrome.. hehee I prayed for a brother everyday during my childhood and my prayer was heard… I got you…. although you never gave me any birthday present except for a yellow tie 6 years ago, your happy-go-lucky and fun to be with, always leaves me smiling especially during most ‘mengumpat’ session about you with our sisters… hehee Having you around is the best gift and suffice without any other present. You are the best. Thank you

Last but not least, the endless list of cousins and friends that stood by me for years sharing my worst and best moment without ever seeking for anything in return but continued to lavish me further with endless presents. You know how much I have always appreciate your presence in my life.. Enough without the need for any more gifts and present, your endless support, non-hypocritical friendship, and prayer for my well being, health, wealth and joy is already the best

Every year for the past 5 years, I always take leave on my birthday with a sole objective of mesmerizing and appreciating another year of life. Every year too except for this year, I failed to do that… this year… I did just that (the whole day!!)……… and I am filled with joy to be blessed with wonderful family and friends. Life can never be as perfect even with the most money, without a wonderful family, relatives and friends. Thank you all for being what you are.. Which is the best ‘presents’ for my birthday!!! May Allah blessed and return the invaluable present that you have given me. Allah Huakbar..

25 RANDOM THINGS ABOUT ME

25 random thing about me.....


I was tagged too many times on FACEBOOK from what is seemed as a polite way to know friends. It may be a catastrophe to know more about me but since i've been tagged several times, i will not spare you from knowing the unbeknown.

RULES (with a minor modification from Facebook). Once you've read, you are supposed to write a note with 25 random things, facts, habits, or goals about you. At the end, choose 25 people and emailed the note. You have to also emailed the person who emailed you. If I emailed you, it's because I want to know more about you.

1. I enjoyed singing but never knew how ugly it sounded. One day, I sang my heart out whilst driving alone from Buckingham University to London and I incidentally dialled a friend’s mobile phone. His mobile phone was out of coverage area and my (incidental) call was recorded in his voice-box message. Embarrass and ugly was an understatement when I heard the replay of the voice-box message.. I did not use my mobile phone for a few months thereafter but continue my out-of-tune sing and karoeke’ing even till today but only with closest of friend.

2. I enjoyed making friends. I can enter, greet and talk to everybody in a hall full of people but I can hardly remember faces and names. I take it as birth defect. There was once in my late teens, I parked myself at a table full with people at a restaurant mistakenly thought them for someone else. After eating and an hour of conversation, one of them politely asked if we have actually met? I wanted to bury myself under the table but I politely apologize and disappear. Ever since, I never approached anybody unless first spoken to. Many may thought of me as unfriendly but I have had too many embarrassing moments.

3. Habitually and subconsciously, I picked my nose in public once too often… for the longest of time! i had only realized my bad habit upon meeting an old high school friend Musa Z, that claimed my habit dated back since high school (I never realized). After that, I was more aware of the bad habit and notice myself doing it so often and felt shameful (at myself). I have to admit that its disgusting but really…. It was really pleasurable.

4. I was rejected once by a girl, my classmate during primary school. I was 12 years old but was too shy and had never spoken to her. After many sleepless nights, I decided to express myself to her by choosing a carefully worded card for Hari Raya. I browsed all the varieties of cards and after much deliberations, I chose a card that read “Selamat Hari Raya Kekasihku”. I bought and quietly left it in her postbox. She must have freaked out and avoided me the whole year until we left primary school. We were 12 years old. I felt so kodi and kampong everytime I thought of it… and could not stop feeling stupid even todate. I mastered the skill and was never rejected by anybody since.

5. I love gardening. I was the gardening association (persatuan berkebun) committee member during primary school at SRK kampong Tunky, PJ, Ever since then, I have been planting flowers and plants. At my old house in kelana jaya, I had my own hanging garden of babylon having converted the rooftop into a nursery. All the flowers died barely a month later although I cannot express my love for plants. After various attempts without success with all plants died, I employ a gardener who maintained my beautiful and colourful garden. Despite my love for plants, we don’t have any chemistry.

6. When my luck with plants ran out, I breed fishes. I bought an aquarium with many colourful fishes for my house. After repeated replenishment of fishes in the aquarium which kept dying, I changed the concept and bought just one but an expensive Arowana which is said an easy care. I gave up my aquarium when the arowana died too in less than a month. Nawal once said, this is how I care for people too.. luckily nobody died…

7. I love running. I used to run for 7 hours on the treadmill every weekend. Now I run every alternate day at 530am for 10 km. When I was staying at my old house in kelana jaya, I run daily 10 km to the Fitness First gym @ the Curve where my driver awaited with my working attire. I would shower, change and go to work from the gym. Simon, a Singaporean friend called me stupid having paid so expensive for a car and a driver BUT had to run to the office everyday.

8. I am a workaholic. When I was working at the merchant bank, I was chased out once by my boss. I discharged myself from the hospital and went straight to work after a major operation to remove glass pieces that was buried in my forehead from a 2 years old car accident. My boss Ramlah Abu Bakar freak and chased me out when she saw the fresh blood and stitches on my forehead.

9. I always lost track of day and time. one day, I woke up and screamed frantically at my driver for not turning up for work only to realize it was a Sunday..

10. I am pathetically a loyal person. I do not know how to mix and add varieties without feeling disgusted. I cannot have Dominoes pizza without the feeling of betraying Pizza Hut. Similarly, I am loyal to Mc Donalds and cant bear Burger King, I love coke and wont drink pepsi and will never take any other fast food chicken but KFC. I am also a Nokia loyalist and cursed at the Blackberry Bold and felt betrayed when the Bold didn’t perform (similar to nokia) as how I expected. Maybe I am a victim of ‘branding’.

11. I love cooking. Dont fall off the seat but I enjoyed cooking when I was in Uni. I was forced to cook with a tight budget. I lived on scholarship and it was impossible to survive without cooking own food. Upon arrival, I went to the local grocery store and bought myself some raw meat for dinner. The meat was fresh and still covered in blood. I washed the meat thoroughly with soap. The meat turned pale white and was tasteless when I fried it with turmeric (not knowing i have to add salt). My mum had a good laughed but told, my dad did the same when he tried helping my mum in the kitchen. Unbeknown to me, washing raw meat with soap won’t make it more hygienic. Later, I learn my love is not in cooking but in eating good food. Hence, I began courting ladies at uni for food which is easier than to experiment own cooking, I ended up being a few kilos overweight upon graduation.

12. I enjoy writing though my vocabulary may not be as rich as I wanted it to be. I have a blog (www.arminbaniaz.com) that I write regularly and is currently in the middle of writing a few books.

13. I love doing the impossible. My first triathlon was the Ironman triathlon, 3.8km open water swim, 180 km cycle and 42km run. I attempted the Ironman triathlon with only 4 weeks of training and I had not swim since pre-school. The ironman was my first swim in open water. I completed the 3.8km swim and abandoned the race at the 136th km cycle. I also attempted the 84km ultra marathon in Singapore without sufficient training. I completed 64km of the 84km ultra marathon. Though I did not complete both events, I love the pain that I had to endure whilst attempting it. The pain may not be as excruciating if I were to have had sufficient training. now i run simple 21km or 42km marathon.

14. I hate travelling. Contrary to my siblings and parents, I just dislike travelling. I hate everything from packing and sit stupidly in the plane (or car) to reach any destination and then get interrogated by the custom officials upon arrival. When I was a student in the UK, whilst other people travelled throughout Europe, I stayed alone at the hostel along very few other students of the same species.

15. I hate queuing. I will avoid any places that I have to queue. When I was in my teens, my friends (very understanding bunch) had to find the manager or the owner of the club to sneak me into a disco or concert without queuing. I stopped going to concert and disco now because I have lost contact with most of club managers, bouncers and owners except Zouk.

16. I love museums much to the bore of my friends. When I was at high school, I skipped (ponteng) classes and spend the whole school time at the museum. My mum never knew this.. ssshh…I rebelled against our education system and discover a more exciting and interesting way to study.

17. I love to read at weird places. At time, I parked myself at a quiet corner either at coffee bean or starbucks and read books or magazine from morning until late evening. When I was a banker more than 10 years ago, I used to drive and parked my car at NKVE Sungai Buloh highway break, read a book and have coffee in my car until after dinner. My friends who saw me in my car parked for hours at highway breaks asked me to seek professional help thinking I was suffering from mid life crisis in my 20s.

18. I never understand gambling. I used to gamble over a game of snooker or pool which I never did understand the concept and I always end-up paying. Though I hate gambling, I will never be the spoil-sport and will bet if asked. I have tried gambling at casino when I was in London but I just don’t understand how anybody could dream of becoming rich at the casino. Casino is a real rip-off but many people get sucked into it.

19. I am a sucker for latest handphones. I used to carry 3 hand phones with different service providers. There was once, I travelled all the way to Singapore when I heard they have launched the latest Nokia Communicator. I bought and paid more than S$2000.00 (RM4,500) and proudly came back to KL to discover the same phone was already launch in Malaysia for only RM2,800.00.

20. I love my privacy. I am very personal person especially with my drawer, hand phone and laptop that I will never allow anybody to even touch it. In the beginning, it created a lot of tense with many believed I have a secret to keep and we argued a lot because of it. But now, most family and friends accepted my peculiarity with my privacy.

21. I love trying out new activities. I didn’t play sport during youth due to my medical sickness. 5 years ago, I was invited to play football in a competition between Proton dealers, proton vendors and proton factory. So excited was I, though I have never kicked a ball. It took me a month of preparation, I bought a new football shoe, socks, uniform etc except for practice. I played against Proton factory led by Tengku Mahaleel himself as the captain. I chased the ball hilariously at one opportunity and gave my best kick only to see my shoe flying off. I stopped playing football. My football shoe that was only worn once, is still new 5 years later. I have a whole cabinet full of new items (including golf clubs that was only used 3x) from experimenting activities. I am sure this is genetic from my dad (dont tell him!)

22. I am snake-phobic. I could not stand the sight or the sound of any snake. A cobra once entered my proton workshop in Puchong and was kept as a pet by my manager, whom promised to safe guard it in an aquarium in the store room. One day, I heard another staff screamed the aquarium cover fell, I quickly jumped and climbed a built-in book shelve in my room screaming for help. My room was on the first floor and the snake was downstairs. That was not cool but I was not amused.

23. I have a bad sense of direction. I got lost in London many times though I lived there for many years. There was once, I came out of marble arch tube station and took a cab to the old Malaysia hall which was located 5 minutes walking distance away. In KL, many times, I have to call my friend in Alor Star, Kedah for direction to go to Ampang. I would like to believe that I was born to be chauffeured driven but the truth is, I just can’t find my way, even in a car park! Now, I have an Indonesian driver to drive me around Malaysia.

24. I love to bargain and negotiate. I probably inherit this from my mum but I just love to negotiate even for a few Ringgit. Once, my sister almost cried sympathising a trader who was trying to sell keropok (prawn cracker) for RM3. I insisted for RM2.50.

25. When I pee, I will flush the toilet bowl and pee simultaneously to race with the flushed water. I always lost. Before I was caught, Nawal always scold Aaraf, thinking he did not flush the toilet properly after peeing. I kept it a secret and stopped the habit.
